eBay has been wrongfully removing my listings. First, they said I broke the counterfeit item policy. This happened 3 times and my account was suspended. Contacted support and got an email back saying there was NO specific reason why my listings were removed and I could not relist them. Finally, got this appealed and the strikes against my account removed. Then they tried to say I am breaking the Vero policy. And now that I am breaking the cosmetics policy. None of which I have broken. They are clearly trying to get rid of me. It appears they are violating the federal antitrust laws by assisting large businesses (high volume sellers) in monopolizing the market. They removing my listings since they are priced lower than the other listings, therefore, take sales away from the larger volume sellers. Also, this means eBay will make less in fees from my listings as well. So they try get rid of us little guys (low volume sellers) because it takes away sales from the big time sellers. I wouldn't be surprised if they have some type of deal with these larger sellers as well. eBay has been sued for violating antitrust laws before. So I wouldn't put it past them. Anyways, I have already filed a complaint with the FTC. Is there anywhere else like the FTC that this can be reported to? It is wrong and I feel like I'm being targeted and discriminated against. So something needs to be done about this.

I don't see the logic in this... the FVFs are the same across the boards, no? Maybe it's because I'm one of the little guys...

 

Either way, relisting after removal is a sure-fire way to get suspended. I can empathize... hang in there.

I'm sorry...I can't provide any help besides condolences.  Your items look totally fine.  There are people out there on the hunt, brands, other resellers.  I imagine brands higher people solely to hunt down people selling their products on eBay.

How upset and hateful of ebay can someone be when they still have 31 active listings, some of which are brand newly uploaded ones?

If your items were removed for VeRO violations, that means it was the manufacturer who reported your item as a violation of their intellectual property. That's not eBay, so you can't say that eBay is out to get you. You need to understand what the real problem is and address it if you can.

 

Unfortunately some cosmetics manufacturers (especially those who use a pyramid marketing scheme) have taken the position that they will not honor the warranties for their items unless they are sold by their licensed representatives. Therefore, they say that without the warranty, their items can't be sold as "new", so unless you're a licensed representative, you can't sell their items as "new" even if they are unopened and sealed. And, since you can't sell cosmetics unless they are new, you can't list or sell them on eBay without violating the cosmetics policy.

 

This is how they are getting around the First Sale Doctrine. To my knowledge, nobody has challenged this in court and won, so until (and unless) someone does that, those manufacturers will continue to have listings for their items removed under VeRO.

 

If that's what happened, then you will need to take them to court to get around this.
