I am a very small seller. I did go ahead and Join Tax Jar months and months ago When all this Internet Sales tax came out. I wanted to make sure I was in compliance, they let you know if you have met the threshold and I have not. ..Well, there seems to be a lot of gray areas. To date I have read about each state and I am concerned about Kansas. according to Kansas, you still have to apply for a Sales Tax Permit even if you have just one sale for any amount. There is no Threshold, this is being appealed supposedly , but I want to be in compliance. What have you other long time small sellers done about Kansas? Also Pennsylvania is a concern, I have not crossed a threshold there but according to the latest information from Tax Jar, they have a Notice & Report law (guess that's like use tax or so they can collect use tax) and you have to set those up even if you don't cross any thresholds or apply for a Sales tax license in their state as well by March 1st. I know that Kansas sales tax Permit is supposed to be easy to apply for and free but what about Pennsylvania, this is all so wishy washy. I just would like some input Please. Help. My tax advisor will not be able to help with this, they don't understand Online businesses. No one does. Help.

I think that someone forgot to tell the Kansas governor that 'Not saying 'NO' doesn't mean 'YES'.

Perhaps if Brains were described as an APP, many people would use them more often.

Supposedly in effect now. Go in to Sales State by State Tax Jar Blog and you can read about each state, scan all the way down when you read it, more involved than I thought. It's not just about collecting sales tax, and I understand eBay is collecting the tax but there is other rules and regulations we have to follow. Good Luck.

I agree the Kansas position violates the principles of Quill.
I was pointing out that ALL owed sales tax is not collected by EBay, there are some states where sellers are still responsible for the taxes on instate sales.

I don't think your point escaped anyone on this thread. And if you want to spend your hard earned money on CPA and service sites to track this stuff for you, that is your decision to make. You have to do what makes you most comfortable.
But I think you miss the point of others. Kansas can not enforce such a law. There is no vehicle in which they can employ to do that. What they are doing is definitely voluntary. So if they write the law scary enough sellers like you will willingly sign up and do their bidding. But those will be the only sellers outside their state they can control. Those that voluntarily sign up.
Again, you need to do what is right for you.

Oh one more thing. If you decide to go the route of hiring a CPA to advise you on this subject, make sure you do your research first. Don't just go to any CPA, make sure they are one that is completely current on the Sales tax laws across the nation.

IF they are even worried about enforcement. It may be that they feel that they are well ahead of the game by saying that their law is mandatory, and that their windfall will come from those that voluntarily sign up for it - without them having to do anything but say it is so. By allowing various websites to promote the 'voluntary remittance' and collect their fees for 'helping' those they say owe, the state benefits minimal cost.

Yes, and that's where the problem is, otherwise I wouldn't have even come into the Board. My adviser preps our other taxes, I have to do my business taxes myself. She's a premium Adviser, CPA all the bells and whistles. I've gone through 4 since I moved up here. They don't get it, one CPA that handles businesses insisted I had to file an annual return for my LLC in SC, and I found out it wasn't even required. The few I have found just don't know what they are doing. I have no problem admitting I don't know what I'm doing and I don't know why they pretend. Still, I'm very glad I came on here. I learned a lot. I'm still going to keep Tax Jar or might switch to the other one. In the meantime, I have my store on vacation, and I am going to take another month and decide if I want to stay open. Thanks for your help I totally appreciate it and learned a lot.

Actually, that is not entirely accurate. Marketplace facilitators can only collect and remit sales tax on sales being delivered within the borders of states that have enacted marketplace facilitator laws.
