We had to remove your listing because it didn’t follow our Prescription and over-the-counter drugs

I got this message this morning. I checked and there are currently 63 OTHERS who are selling the very same item! Also, there have been 26 actual sales of them since October 15. The notice I received says:

“What is the policy

 

- Prescription drugs or drugs containing prescription-strength medication cannot be listed
- Over-the-counter medication containing non-prescription strength drugs must:
-- Clearly state the concentration of the prescription drug in the description
-- Not be expired prior to reaching the buyer and clearly state the expiration in the description
- Herbal, holistic, or drug-like remedies can’t imply any non-government-approved treatments or be compared to any prescription drug
- The item is not allowed to claim any health benefits from legal substances that the Food and Drug Administration (FDA) hasn’t approved"

 

UV-C is an efficacious non-pharmaceutical measure to inactivate pathogens where natural or mechanical ventilation is inadequate.” From the Global Lighting Association.

 

I checked the VeRO files and the company, Ontel, is not listed. It appears that I was called out for  a 'DRUG' complaint, when there  are NO drugs involved. I also checked the referenced files with the Global Lighting Assoc. and their recommendation is to give ample notice of the possible hazards of using it.  The box does have warnings on the outside. I have not opened one to see what warnings might be inside. 

 

This is NOT a 'drug' nor any kind of a medicine. It is being sold all over the internet! There are also many other, similar items being sold, both on eBay and other venues. There is NO medicine or ANY sort of 'prescription drug' in these little lamps. It does NOT claim to have any healing or other qualities. The link to the FDA does not work. 

 

So, my question is: WHY am I being singled out for this? Is it that some other seller is mad because I am listing it? Am I interfering in 'their' listing? There are all SORTS of 'UV' lights listed on eBay, Amazon, etc. and none of them are considered 'dangerous'! 

 

I wanted to send this directly to Customer Service, but that seems to be impossible on eBay, now. There simply is no way to do that, it seems. 

 

 

This is not a big seller for me, but I feel that I should be able to list it, with clear and accurate descriptions. They do serve a valid purpose, in this Pandemic we are all living under.  

If I was trying to  sell something like Fentanyl I could understand the concern. But THIS is neither a drug nor a medical device. It's a small handheld lamp, to be used for disinfecting your cell phone, your car keys, or whatever. It is NOT taken orally, or any other way.

They might have objected to the phrase "inactivate pathogens" as a medical claim.

That's a medical claim no matter how you phrase it.

Unfortunately, eBay has made their decision best to accept it because it is their web site, and they make the rules.

My advice is do not attempt to list this item again or you 'may' risk suspension

You are probably right. What really burns me is the fact that there are SO MANY others, on EBAY, selling the very same thing, and they will STILL be there next week, and next MONTH, too! Will they be kicked out, too? Not very likely!

 

It's the same with the vinyl cushions I tried to sell last year. The ones that Medicare says you need to replace monthly, for your CPAP mask. You do NOT need a prescription to replace them. You DO need one to replace the CPAP machine, itself. This is what happens when people who don't know what they are talking about are in charge of deciding what everyone ELSE needs to do, like the current 'pandemic'. 

 

It's OK, though, since nothing seems to be selling on eBay right now. It was fun when I first started, back in the day!

This happens to me as well. Unfortunately, all of us sellers are in a world of computer analytics, and bots that decide if a listing should be removed. Not a human. And every time this happens it is due to a "government body" Ebay says..AI is going to make this worse

Hi, you might want to start a new thread as this one is over a year old. Folks might answer the OP and may not notice your post at the tail end. Old threads have a tendency to get shut down by the board mods.
