VeRO Unauthorized Item - How Can I Prevent This?

Hi everyone! This is my first time posting here. I am a reseller of mostly salvage goods. And sometimes overstock. In the past few months, I have had a number of listings taken down. The most recent was an AirPhysio device. The messages from eBay always say it's a counterfeit item, but I don't sell counterfeit items. These are items that were lost in the mail, involved in an accident, etc. The really maddening thing is that there will be plenty of other listings for the SAME item currently active on eBay. But for some reason, I am targeted. Because of that, I'm getting VERY disenchanted with eBay. There's never anything they can do to help me. It's assumed that whoever filed the claim is always the one that's right. I have been researching the first sale doctrine, and it seems that's a defense for me. But it's not like I'm going to sue any of these companies over a few items. I always have a WIDE range of things for sale and not 100 of something. Any advice on how I can prevent this in the future? Short of getting off eBay altogether?

Sorry for your situation.  However, if Ebay states it counterfeit, that's that.  Do not attempt to relist it or you will jeopardize your account.  And just because others are selling the same doesn't make it right.  They just haven't been caught...yet.  Not trying to be rude here by any means. Just letting you know it's Ebay's playground and they make the rules.

@flipflopstanktops   can't prevent it if the rights owner thinks it's legit or u have a competitor(s) making the report(s). All eBay listings have a 'report this item' button on them, so u or anyone can use it.

FYI- I had a listing taken down bc I had the word 'bomber' in the description and title. Why did I have that word? Because it was the brands color name: Chocolate Bomber.

 

The company, a totally different brand, said I violated their rights bc they have the word 'bomber' in their company name.

 

I wonder if they'll sue the United States Defense Dept and Military Depts LOL

I had a similar problem without vero indication. the main problem here is how a seller would know if the product going to be listed will be found unauthorized/counterfeit by ebay or not before listing? there is no way to predict/know this?

I am trying to figure out how to avoid this, asked ebay CS and they couldn't even respond what I'm trying to understand. because of this I don't know how to build up a safe account here with their non helping approaches.

You can't predict or prevent it.

 

Vero abuse is rife and it's only going to get to get worse as more and more get away with it.

it wasn't a vero. but my concern is what I am going to face when i list a different item. it feels like a booby trap. i'm stuck for my next actions.

so shouldn't i list even a different product too because I can't know what would be ebay's reaction and when i list a different product this would cause a longer restriction too as i understand from their actions.

on the other hand the products was a vintage adidas tshirt, the weird part is i have other 10-11 listing of these group without problem too. I'm sure that whoever defined my product as counterfeit have no idea about vintage products. most of my inventory have even the cardboard tags on, deadstock, purchased by my family members at their eras from official adidas stores.

Or anyone who sells bomber jackets.

 

And how about companies such as as Bomber Eyewear, Bomber Ski, Bomber Fishing Lures, et al.  And there's a cheddar cheese called Black Bomber.  And how can we forget the Winnipeg Blue Bombers?
