USPS Packet Loss Compensation

Please help me understand the situation. The eBay seller sent the purchase to the buyer, but it was damaged in transit (there is a letter from the USPS confirming this). The buyer refuses to receive it and USPS sends it to the seller's address. The seller does not receive it ( no # tracking ). Who should pay compensation to the seller and the buyer? What is the role in this eBay , PayPal ? Thank you.

The buyer needs to accept the package and file an item not as described claim...it is in the money back guarantee policy.

No tracking number? Was this a regular Letter?

 

The seller compensates the buyer (full refund)

USPS compensates the seller IF the seller obtained insurance

eBay has no role other than to refund your fees when you refund the buyer

PayPal? no role whatsoever!

You send the buyer back their money and collect from USPS. Since you say USPS confirmed the item was damaged just show that report to the person at the counter.

@aleksgold1952 Once the buyer refused to receive it, they lost the money back guarantee protection. If you are in fact the buyer, you messed up with that choice. If you are actually the seller, the correct thing to do is to refund the buyer, at a minimum for the item purchase. Up to you if you also want to refund the shipping costs as you did nothing wrong, the fault was on USPS. Your own refund may not occur for several weeks. Best of luck to you....

it can take a long time for a refused package to get returned to sender. You didn't mention the timeline here, but it could well still be in transit.

 

Without a tracking number or insurance, the seller will not be able to collect compensation for a lost package. The buyer should be refunded in full by the seller. Sellers are held accountable by eBay for shipping damage. eBay’s view is that the carrier is acting as an agent for the seller. That is how it works on eBay.

 

Why wasn't there tracking on this item?

I couldn't find the wording, but isn't it stated somewhere that receiving a damaged package is one of the reasons for a buyer refusing the package and still be covered by the MBG?

I'm not aware of that and don't see it written but wouldn't surprise me if it's in fine print somewhere. As a buyer I would never refuse delivery regardless because you are limiting yourself right off the bat, but that's me....

You need to refund the buyer the entire amount.  The buyer bought an item and expects to receive it in the same condition as listed on the auction.  The buyer sent you the letter, correct?  You refund.  If you had insurance, you file a claim.  If no insurance, you might get a refund of the postage if you go to your post office and the supervisor knows you or is understanding.

 

Even though the post office messed up the item, you could have always packed that item in a bigger box or a sturdier box.  I know, I know, sometimes, no matter how you pack, it gets destroyed.   But remember, the buyer was expecting the item to arrive perfectly.  It did not, so you need to refund.  Apologize profusely even though this might not be all your fault.   Some of today's buyer are downright mean and you don't want this one to give you a negative.

In short- eBay or Paypal have NO PART in this. 

 

You sold.

The buyer paid so YOU need to refund the buyer

then YOU can fight it out with USPS for not 'giving' you the item back. Win or Lose that battle, the buyer should NOT be any part of it.

Customer Service eBay "eBay Money Back Guarantee policy" has "The buyer refused delivery of the item"
- Covered:
The item arrived with shipping cost still owing because the seller didn't apply enough postage
- Not covered:
The buyer refused delivery for any other reason
If a package arrives empty or WAS DAMAGED in transit, the BUYRR SHOULD accept the delivery and report that the item doesn't match the listing.
