So I sold this movie Nov 14 and ship the item on Nov 15. The item was new and it was wrapped in plastic. It's never been opened. Last Friday, Nov 23, the buyer sent me the message saying he received the item and there were no discs when he opened. Even though, the claim did not make sense at all, I asked him what the actual problem is and how he wishes to resolve the issue. I asked him twice but he hasn't answered to those messages during weekend.
But then today Monday 26, I've got the return request from ebay. The buyer says that the item is not new. There's wear and tear on the item. There are no discs in the item and he's asking full refund. He also included the photos of item. There are cracks on the case inside. There's also a lot of wear on the case outside. By the look of the wear on the edges, I can confirm that this isn't the item that I've sent. It's clear that the buyer bought my item just to replace his old one for free.
Do you anyone have experience like this? What's the procedure in this case?

Call ebay and upload his messages.
The one where he says there were no discs.
The other where now he says they are scratched.
Ask that they close the case in your favor while you remain on the phone.
If the first one won't try again. You may get someone who actually understands this buyer is lying.

You misread the OP post. See how easy it is to do. The case was scratched and no discs inside. Quite possible. Folks we know that used to big CD sellers here had a machine that sealed discs. They were sealed but not brand new. OP has no way to prove that the discs were in the case so they must refund. Sucks which is why I spend my Sundays selling at the flea market. Over and done with.

Welcome to the new Ebay, where the River (that other company) is putting its shadow on our neck. Buyers get to ge their items for free after they invent whatever they feel is enough to get a refund while you get stuck with the time wasted, loss of the cost of shipping materials and money.
I had a guy buyign some things, he wanted to impress daddy. Except the thing he bought was to be for A, not B. He returned them while the CS guys were lecturing me about why I should refund a guy not knowing what he was buying. Nice to lose half of the item's price only in shipping, right? Then you have to discount what you paid for it.
Accept it as way to do business on Ebay. I don't like it, but when you have the peloton of guys ready to execute you, you have to smile and take it as they come.

No, that's not the case. I've been collecting cassette tapes, LPs, VHS, CDs, Laser Discs, DVDs, Blu rays, and more for decades. It never happened nor I heard that happened to someone when they bought new copies at the retailers. It's not even one of those second hand items that were sold in small record shops. I would understand if the disc is faulty even though it's new. It's quite rare but it does happen.

Do you think that the case was stepped on by anybody on its way to the buyer? It may not have damaged the disc, but it was enough to play wolf.
I had a case once, the buyer after 30 days sent me a request for refund because the CD was scratched even though it was brand new, sealed. Had it been 3 days or a week after receiving it, I would refund.
In the past, I used to buy lots of brand new CDs/DVDs by the hundreds, paying a couple of bucks. Only to find out they are from a no good to listen or to watch singer or actor. I opened the cases to keep them for replacement, but never, ever encountered one empty one, and I am talking about cheap stuff.

If you sent it without knowing what's inside, just refund and move on.

You may not but as a retailer of this type of item in the 70's, 80's & 90's I can assure you that it can happen. It's not what I would call common but it happens with automated packaging lines. Just the same as when you get two discs in a case instead of one, usually means that the next case down the line get no disc!
If you think a dvd pressing plant can't make a mistake you are mistaken. I can say that USPS has never lost one of my packages out of thousands I have shipped but I certainly wouldn't claim that USPS never loses ANY packages.
Seems to me to be a lot of effort to go through to scam a $15 item that is easily obtained. While I wouldn't say that scams never happen for $15 but it's not common......just like a missing disc it can happen!

Spot on-it can happen. I once bought a sealed dvd from Walmart and there was no disc inside when I opened it. It can and does happen although very infrequent.

It seems, though, that the first thought is not can this happen, but it's a scam.

I agree, none of those other posters even remotely got the gist of your post. Considering I sell similar items on my other account, I will give you my experience: It's never happened to me. Good luck with everything.

@e.j.kim Yep, had the exact same scam with one excpetion, the Buyer said they have no way of taking pictures ... RIGHT! Like we believed that ... anyway, in place of the factory sealed movie collection we received the Buyer's old, scratched and abused copy ... obviously no help from Home Office so it was eat the cost and move on ... wonder if it isn't the same Buyer?!? They must have a great movie collection by now ...

The exact same thing happened to me except my item was a designer bracelet with diamonds. Seller opened dispute through ebay and uploaded a picture of a tarnished, clearly fake item that didn't look like what I sent him at all. He asked for COA despite it being clearly stated in my listing I did not have it and would not include on. I sent him what I did have which was a certificate from the jeweler stating the diamonds were inspected and GIA certified real. He still wanted to return. I happily obliged, thinking he would return, I would refund, and it would be over. Well he never returned after I even paid the return label for him to do so. The window expired and ebay ruled in my favor. He then went to his cc company and disputed the charge there. Paypal rep assured me it would be ok, to upload my pictures as backup and I had a 100% seller rating so I would be fine. CC company sided with him for reasons I do not know, paypal claims they don't know either and there's nothing they can do. I am appalled at how many sellers are getting frauded like this and I will no longer be listing my designer items on ebay. I wish you luck.
