THEFT OF PACKAGE

I was wondering if there is anythingi can do to get my items from someone who wasnt supposed to get my package,opened it realized it wasnt thiers and kept item im the person who supposed to get item seller sent to wrong address i dont want the seller to get in trouble because he tried to get item back but was blocked by person who recieved package any ideas on how to proceed?

If it  hasn't been because of the other possible ways the package got mis-delivered, (your address was incorrect/the carrier goofed/the seller changed the address) but that the seller put another person's label on your item, there is nothing you can do.  If some one mails you something you did not order, your are under no obligation to return or pay for it. If someone received your item in a package that was addressed to them, all you can do is hope the seller has a replacement for you. If no replacement is available, you need to request a refund.

If that is the case -  buyer can keep the item.  Zero that came be done.  Your seller made a mistake.

The first response to your thread was the correct response. File an item not received case, INR with eBay and the seller can refund your money. You will find the refund tab on the purchase page dropdown next to the item you did not receive. Good Luck

So you are going to tell the police you mailed the buyer something that you want back?

 

Was the item the buyer received with a shipping label addressed to them ?

 

There is no theft or fraud. Your mistake, buyer not obligated to return.

 

I'd report you for abusive scare tactics, and give negative feedback if it were me.

No. That answer is wrong.  The seller sent it to the address on the payment.   THE SELLER IS NEVER RESPONSIBLE BECAUSE A BUYER NEGLECTED TO PUT IN THE CORRECT SHIPPING ADDRESS.  The person that received it is NOT the other buyer.  The person lives in the buyer's previous address.  He chose to keep the item.  The post office can NOT make him return it.  The police might come and suggest that he /she return the item but they can NOT force the person to give up the item.

 

My question to the poster is why did you not put in a change of address at the post office?  This is free.  Unless, you are on the FBI's most wanted list or there is an arrest warrant open for the poster, it's always a good idea to put a change of address when you move.

According to a reply from the OP in Message 25 (here), the reason that the seller is able to communicate with the guy who received the package is because that guy is a previous customer of the seller, so the seller has his contact info. There's no indication that the package arrived at the OP's address (or even a previous address). The OP says that the seller obtained a QR code from eBay, meaning that he would have had to show it at the PO to get a label printed there.

 

The working theory at the moment is that the seller showed his post office the wrong QR code, either for a previous shipment (to that recipient who won't give up the package now) or for another shipment that same day. As the OP has not said anything about receiving a package containing something that he didn't order, I would lean towards the possibility that the seller accidentally showed an old QR code for a previous order, rather than this being a mixup of multiple labels.

 

In any event, if the tracking number for the OP's shipment does not show it as Delivered (by the last Estimated Date of Delivery on the order) to the City and ZIP of the address provided by the OP at payment time, then this should be a slam-dunk refund for him.

Ok, I take my post above back. I just re-read everything.  The seller should have just refunded when he realized that he sent it to the wrong buyer.  Sorry for my mis-understanding but at least I know that I wasn't the only one.

 

I will say that sometimes,  when I hit print a label, I will get a random label from something that I sold months ago.  This is an ebay glitch because I know that I clicked the item that I just sold the day before.  It's random. Thankfully , I print with the receipt and I always read the title on the receipt to make sure it matches the item that is in the box.

Sure, but the chances of the "other buyer" having the same Zipcode  as the OP who didn't get their stuff would be quite slim.

I don't believe that the OP has ever said that it was. It went to the address of a previous buyer (from that seller), and the guy who received the OP's package is refusing to give it back to the seller. The OP may need to file an Item Not Received dispute in order to get a refund from the seller.

my address is correct he used a qr code from ebay where the post office prints label so it wasnt my qr code that was printed it was the person refusing to return package
