Suing eBay

Buyer claims I sent empty box. Then decided in the buyers favor because he filed a police report. I try to appeal case but they simply won’t let me appeal. Now I had to shut down my business and I’ve been doing business on here since 2009. Has anybody sued eBay?

Read Section 18, Legal Disputes, of the User Agreement with eBay that you signed.

Not successfully since we all agreed to arbitration in favor of the giant.  I would advise against listing a Surface computer on ebay if you just got stung.  Unless you ran out of options like selling it locally to a friend or family member.  

Oddly enough maybe five years ago I won my current Surface computer through a cereal box contest.  Couldn't believe my luck when I read the odds on-line once I cut the winning coupon out of the box.  Just cost me a registered mail response with the filled out coupon enclosed. About four weeks later the Surface arrived.  35,000 to 1 odds.

eBay's policy regarding legal disputes is nonsense and won't stand up in court. Anywhere. You absolutely can sue eBay and win. Additionally you can also start a class action lawsuit against eBay is you choose. Whatever is decided will be decided in court. Sue away.

You are selling a few high priced items that neither your average sale nor volume can cover.   And some of those are electronics, one of the most scammed categories on Ebay.  You are, perhaps, lucky it was not that $3,900 widget.  And you really should take down the listing for the Microsoft Surface laptop.  Run all your recent sales through a statistical calculator to find your average sale and the standard deviation and then never list an item that lists for more than one standard deviation form your average sale.

As for suing Ebay, forget about it.  That action, if not the entire US legal system, even if you weren't forced into arbitration,  is reserved for wealthy people who can afford to take financial risks without blinking.  And even if your $3,900 widget were scammed and lost it would be a small claims matter in most states and you would have to file in San Jose.

They filed a police report which is no small thing. And you wanted to sue ebay?

They would say "Well... there's a police report".

Did you not insure the package? I'm just wondering who "sues" who here.

Well, rats!  Now I have to go count posts again, because I came up with 22,972.

Don't sell expensive items on Ebay. It's an open invitation to get scammed. I would rather go to a pawn shop and take less than have some scammer steal from me.
