Buyer claims I sent empty box. Then decided in the buyers favor because he filed a police report. I try to appeal case but they simply won’t let me appeal. Now I had to shut down my business and I’ve been doing business on here since 2009. Has anybody sued eBay?

Your issue is with either the buyer or shipping service.Can you prove item was in box when received by buyer and not perhaps stolen in transit?Why should eBay take your word over the buyer's?What seller protection do you think eBay offers that applies here?

They are doing the same thing to me, I have been a perfect seller for years. I am bringing them to court. I don't can who claims you "can't" that's nonsense. They are also legally required to tell me where to send the small claims court paperwork. I asked them 15 times, no answer. I will also be suing them for damages.

Absolutely, you can file a well argumented and documented small claim law suit, and the odds are pretty much on your favor, the reason why you don't see that happening often, is because it is a somehow lengthy process, and requieres time and several steps, but all that time and effort can add up to the compensation owed to you. Another helpful step would be to specify that the whole case is non confidential, and if you end up winning the case, you could and should make it public, this would help thousands other potential victims of ebay's arbitrary policies, to go forward with their claims against ebay's sistemic siding with buyers in order to scam the sellers. EBay truly have a very faulty set of policies, and the best (or worst) thing of all is that an issue like scam, fraud, and extortion, can be replicated over and over with the same results, EBay always sides with the buyer and rips off the seller. Remember, you as a seller, are paying a very high commission fee for your sales to EBay, so they should provide a much more secure environment for honest sellers, specially sellers with a long history of satisfied buyers on EBay. All of this is can be added arguments on a court hiring, after all, it's not that difficult to explain when you have been robbed or scammed, how is it that it happened, and how EBay allowed and enabled buyers to defraud you in the first place.

Don't be intimidated, EBay does have a huge army of lawyers working for them but, you can very easily convince a jury and judge, that all that legal bullet proofing on Ebay's side, is simply there to allow or help them get away with their unfair business practices.

Yes, you can sue eBay. A judge can throw out the arbitration bull***t.

ebay has run me in loops for 4 weeks on a 245$ sale. my account is in 100% above standard standing. They sent my money to an account that doesnt exist, their system said It was an account that is accepted. now, my money is gone. Its not in ebay, its not at american express. its gone. american express has no idea what this so called "reference number" is. Ebay has made zero attempts in 18 calls and 68 account interactions to rectify this. Also .. they are 'charging' a 35.00 fee.. so the amount is only 194$ after shipping, which the buyer paid. She has had the item over 2 weeks now. Also, she is very pleased with her purchase. I have removed all my listings from ebay, and will never deal with them again. I will close my 'account' when this matter has been resolved as I am turning this over to the authorities, as well as better business bureau. This is clearly unacceptable, and no one in these times especially.. nor anytime..good economy, or bad economy.. should ever have to endure. I will also be going to the local news channel as well. It states, for help, and support. in all these calls,.. have I ever been given an answer that was even true? What about the system, accepting the card as a suitable card for payout accounts? I have been patient, I have been calm. Today I am anything but that, My electricity had even been shut off. My first time ever in 50 years. This is unacceptable, and who collects all the interest on al the people they do this too?.???!! This should ,make excellent media. Good day.

Well i have a situation where i have contacted legal council and depending on what ebay decides to do I may be the first to tread those waters. I am an ebay user for over 20 years I have had a store for over a decade and sold prior to the store on a smaller scale. A buyer ordered an item on a Thursday evening ( I primarily sell films (digital media) buyers are given the option for first class or media mail. I state that I process orders within 2 days I have stuck to that with 99.9% of 50,000 items going out within those timelines. Only a city wide flood and a massive snowstorm and a death in the family caused more than two day shipping and in all cases I contacted the buyers and advised shipping would take an extra day. That has been one of my promises to my many customers. As you may recall last year (during Covid) the USPS was a mess and a high % of packages were late some extremely late. I lost hundreds of dollars and although buyers got refunded items still arrived. Only one of dozens of customers returned the funds and most never contacted me to say they received their items. ebay stood by and ignored the USPS problem giving sellers a difficult time and knowingly refusing to give back money once they refunded the buyers for LATE shipping. Basically ebay took full advantage of sellers. stealing from them. I got a long list of several hundred sellers that took it on the chin last winter.. Today I was extorted then defamed by a buyer who demanded a refund after he saw the item was arriving today. The item was mailed over a holiday weekend and it took a few days longer than the average shipping time. I notified the buyer as USPS posted the delivery day early this morning. The buyer filed a case about an hour later I got the tracking info and he received the item BEFORE filing the case. He demanded money and fabricated a scenario claiming I held the item back from shipping, he stated I refused to ship the item when it was ordered which he stated should have shipped on the Thursday he ordered it. It was ordered at 10:01 PM that Thursday well after the USPS was closed. I processed his order that Sunday and dropped it off at my Post office. i have never worked on Saturday and Fridays if I can get to the post office I do but another job can often make Friday difficult which is why I have a two day shipping time. The buyer clearly demanded money back and I refused stating the item is not lost by USPS standards until 30 days for Media mail and it will be delivered TODAY. . It had only been five days when the buyer started his demands. He continued a half dozen times from 10/18 until today. His case was filed after the item was delivered and ebay knowingly allowed him to file it. , So ebay supported this buyer refusing to remove his extortion and defaming FEEDBACK which was a complete published lie. They still have not released the funds knowing he filed AFTER receiving the item. I asked for them to close the case and they refused. I am a TOP RATED seller with no negative Feedbacks that ebay allows a buyer to violate policy and provide false Feedback and i sent them all the proof of when the item was ordered and shipped and that they allow a buyer to demand a refund or leave negative Feedback and then allow this Feedback makes them the ones publishing Defamatory FALSE information that affects my business. According to ebay policy they do not allow feed back extortion. I am going to wait a few days before risking my business and filing a massive Class action lawsuit against ebay for allowing users to publish defamatory comments about sellers. Supporting Feedback extortion and refusing to pay and allowing cases to be filed knowing an item has already been delivered. They are KNOWINGLY not only allowing defamatory comments but they are in effect encouraging it. I will ask the courts to permanently remove all feedback commentary and force a system of boxes to be checked off. eBay can not be permitted to allow buyers to defame sellers they can not be permitted to allow FEEDBACK EXTORTION and they must pay a seller once the item is delivered. These holds after delivery are clearly illegal and used to hold on to money for interest. The idea that a buyer can extort a seller and a company such as ebay supports extortion then allows the buyer to defame the seller needs to be contested. No newspaper in the land can get away with publishing falsehoods and it has become due time to test the waters with the defamed sellers that have put up with unfair policy that permits ebay to publish these false comments. I do have civil rights and I have worked alongside attorneys for the past 40 years. I know many top attorneys as i have been involved with a business that uses attorneys regularly. I am ready to test the waters and i have discussed the posiblilty with one councilor who will put me in touch with a group that works with American Civil Lberties. I do believe it is time to contest ebay's policy which in my situation is absolutely and deliberately illegal as well as in violation of my legal rights.
So the short answer is we need sellers to gather to discuss a plan to make ebay a better place to sell. if this means suits coming forward i am all for it. I have no fear of the hammer coming down on my business ebay is well paid in commissions and suing them may be rewarding for sellers. As a group we have a much better chance and I can see but what is going on that ebay may be in for several surprises. This will take money guts and fortitude. this corporation needs an adjustment and a good long drawn out battle between its sellers and eBay drawing through the public eye and covered by the press is definitely on the Horizon.
There are alternatives to selling on eBay. I think getting money back for the abuse might need to other openings as well/ As a buyer I am frustrate I can not begin to tell you how many have sold on auction and refused to deliver while ebay had thousands of my dollars on hold. I do get it that a feedback system can be helpful but allowing buyers to abuse sellers iand taking away sellers rights to rate buyers seems very one sided and extremely abusive under the current conditions. There is a way for sellers to form a bond. My suggestion PENNY items with digital shipping for free. an email address gets info and we now have a Union. We need a sellers Union in order to legally fight ebay. You realize we have to figure out how to sell the idea to others so "not many sell for a penny" is definitely the way to gather a group. I suppose ebay will catch on and remove this idea but here is a way to communicate and gather steam. There are currently no rules against selling anything for a penny. That is how we should start gathering info for a suit.
