Sue eBay

Can I sue eBay from ending me item saying it was offensive?  I see the same item still up for sale by several other sellers.  eBay is taking away my livelihood.  Any suggestions?

You can sue anyone. Would you win? Would you even get your day in court? Highly unlikely.

 

That said, if you're going to sue them, I'd sue them for discrimination. It seems by taking down predominantly black depictions on their website they're discriminating against black people.

 

If you look at their white corporate officials, it makes sense: they don't won't black in their leadership why would they want them on their website?

 

eBay is racist.

You'll probably see those other listings gone within a week or two.  They just changed the policy and started ending listings today.

Sue them for what, It's their site and they can remove any listings they want.

The other items that are still listed will be removed soon.

The user agreement strips us of our right to sue in a court if I understand right. Instead if you have a dispute with eBay you have to use eBay's hired "arbitrators" to handle the dispute. The house always wins is my guess.

no agreement is solid, that is what court is for as the laws constantly change. However, in this case, ebay has made a new policy and to sue would likely be waste, it calls for ebay sellers to ban together, make their case to ebay and see if any headway can be made.

@gwzcomps is correct. There is a lot of legalese surrounding it but, essentially, you can sue them in Small Claims Court. Otherwise when you signed up to sell, you agreed to the terms in the eBay User Agreement that states that, in lieu of court, members agree to use binding arbitration for legal disputes. In this particular case, you also agreed in the UA that you would defer to eBay who has the sole right to end your listings for any reason. So you do not really have grounds to sue them. I suggest reading the UA and familiarizing yourself with its terms. Below is a link to it.

Yes, by all mean go for it. Go talk to a lawyer tomorrow as he will be happy to sue Ebay because you lost a couple dollars in potential sales.

Whether or not the UA's ban on taking legal action against eBay would hold up in court in all instances is something that the courts would have to decide.  However, I'm not quite certain what it is that you want to sue them over.  If you believe that there is some sort of discrimination going on you will probably first have to prove that your listing is protected from discrimination because of its protected status.  Frankly, I'm not sure that there are too many attorneys willing to take such a case unless it is one of civil rights groups.

Nope, the User Agreement that you agreed to when you signed up says basically that you  will not and cannot sue them

Brilliant. Ebay wont allow pictures of black folks on their site. Sounds racist especially if they consider black pictures offensive. Ive got pics of me with black family members in them. Had no idea it might be offensive.

When the UA was updated (in 2012?) to include requirement of binding arbitration, there was an option for those of us who did not want to be handcuffed by that to opt out of the binding arbitration, but it required sending a hard copy letter within 30 days of the release of that UA. Which I immediately did. I still have the signed card from the certified mail I sent in my files.

Anyone joining since then does not have that option.
