State of Ohio demanding proof from Seller that eBay paid Sales Tax

Good evening guys,

 

Per the title a Seller in Ohio is reporting that they received official communication from the state and their local Sherrif's office that they need to provide proof that eBay paid Sales Tax on transactions.  This has some pretty far reaching implications for many Sellers if this type of situation has not already been addressed.

The Seller has not gotten any support from eBay which in fact should have records of each and every transaction for every Seller and the tax collected and remitted to the state.

 

So the question is this, where is the convenient place that a Seller can simply request and receive in a timely fashion the information the state is asking for?   Please note in advance that this is a general question for a specific situations that can - may - is affecting Sellers in Ohio and is NOT account specific so I am not looking for a "have the Seller contact CS" on this one, there should already be a procedure in place OR what is supplied to the state of Ohio providing the proof Sellers (plural) require.  ...

You can see how much tax was collected under the “sales” tab however, we don’t have any way of verifying that eBay sent that collected tax to the correct tax department. I would contact eBay for business via Facebook and ask them to forward your request for clarification to the accounting department.

Wait what? Doesn't the buyer pay the sales tax, and eBay remits it to the buyer's state?  This doesn't add up. Why would the state (any state) go to the seller  "to provide proof that eBay paid Sales Tax on transactions?"  Like, why would Ohio care if eBay remitted sales tax to some other state?  The only sales tax Ohio is collecting is from purchases made by buyers in Ohio.. I'm not buying this story.

@hartungcards   I "get that" but if your state asked you to provide proof that eBay paid the sales tax that they collected on transactions how would you do it?  Proof has to come from eBay AND the Selling account has to be referenced.   If mine did that to me I would have no clue how to get the proof from eBay ... so I am trying to find out if there is something in place for that purpose.

@johnson_junk_company   I am hopeful that there is already something in place for this kind of request ... however, if it were me I am not on Facebook so that option is out.

I think you're on pretty safe footing doubting this tale.  I started doubting it as soon as I saw "official communication from the state and their local Sheriff's office."  I don't  know of any local Sheriffs that get involved in a state's accounting matters.  I also get a lot of "official communications" from people trying to sell me auto repair insurance.

@a_c_green   I am confident the member will post here at some point.  I will also be curious to see if others in Ohio have experienced the same issue.   I am in PA but if I were asked for the same info I would be SOL so I am hoping eBay has something in place for each Selling account that can be submitted to the state if requested.

If my state "asked me to provide proof that eBay paid the sales tax that they collected on transactions," I'd tell them to go talk to eBay, and then get back to doing what I was doing before being so rudely interrupted.  I might also report this "official communication from the state" as some kind of phishing scam.

Perhaps "a seller" has been collecting sales tax on off eBay transactions/business but not remitting and claiming that eBay is collecting it all.

 

In any event an eBay Transaction Report will specify Sales Tax collected by eBay for every transaction, it also displays the State and buyer address.

I'd check the Ohio State sales tax law on internet marketplaces.  I think the law directs the "marketplace" to collect the taxes........and I would so direct the "sheriff" there..........

If this is indeed the case, shouldn't the State of Ohio or the sheriff's office ? be smart enough to contact eBay? How would the seller be expected to know that for sure? Something smells.
