Sold a phone AS-IS PARTS ONLY, now buyer wants a refund

I sold a phone listed as "parts only as-is. Phone can not be activated." Buyer wants a refund saying the battery does not hold a charge and want's a phone that works.

 

What is ebay's stance on a case like this?  Should I find out or is it not worth the hassle and just issue a refund? I'm not sure what about parts only was not understood in my description.

 

And a follow up question, what if I  get back the phone in worse condition that I sent it in?

Stance is you either take the return back and refund in full, or ebay will do it for you. There's no out on this, all you can do is try again (and I would email the next 'buyer' that they know they are buying a phone that is broken and needs repair or may not ever work even with repair, and is just for 'parts'). 

 

Getting phone back in worse condition, doubt you are a TRS so you can't do much of anything except 'report the buyer' and all that does is put that person on a list, if they make a habit out of it, they will get banished or?

Great condition Galaxy S9. SOLD AS IS, FOR PARTS ONLY. It has a bad IMEI and can Not Be Activated. Fully functional. Has light and minimal signs of wear and use, but is fully operational and functions as intended.

He's got it listed under "for parts only/not working" though - and states that it has a bad IMEI - seems clear enough that the buyer purchased a phone listed as 'for parts only' and not working and expected it to work. I don't see that as a done deal.

NORMALLY if you list it not working for parts only and say bad esn bad imei can't be activated  you can decline the return if your policy is no returns.  Do you have the option to decline?  

 

If not then ASK eBay to close the case in your favor.  

 

HOWEVER, be aware since you said it's fully functional and has light wear they can dispute it's fully functional if it won't hold a charge.   

 

You should have said NOTHING about it working.  When it's sold NOT WORKING you can't say it's fully functional.  It cancels Not Working.  When the condition is not working the battery can be bad or it might not hold a charge and you don't have to know that.  You're hung by your own tongue.

The seller listed a phone that was fully functional aside from the IMEI. 

 

The buyer got a phone that was not fully functional aside from the IMEI. 

 

Listing as "for parts/not working" does not protect a seller who misleads a buyer by omission. 

 

If the seller wanted the buer to understand that nothing was guaranteed to work, the description should have said "no part of this phone functions properly"

Even though it was listed for Parts, if nothing was mentioned about a bad battery, that would be a good reason to return.

I understand - it's just that eBay has been pretty positive about that category as a blanket statement in the past, at least in my experience, which is why I didn't think it's a done deal.  I'm wondering how one can know something is fully functional with a dead battery, though.

You messed up and provided too much info in your listing. If you had just said, as is for parts not working, then you would win. But you discussed functionality, so you will lose a dispute.

Even if you win, you will end up with negative feedback.

I sold a Nintendo DS once, as is for parts. I stated it would power up (which it would), but would freeze just saying Nintendo on the screen. I stated that was all I knew and item was as is.

A guy bought it and I shipped it. He filed a SNAD saying the unit was water damaged and wouldn't work (you had to disassemble the unit to tell this, which he stated he did. I fought him and won, both on grounds of the description, and that he had disassembled the item after receiving it.

Then he left negative feedback. I tried to have E-Bay remove it, and they refused.

So I mostly won, but lost a little.

The description doesn't matter anymore.  There is no winning NAD cases anymore.  I lost one recently where the buyer was upset the broken laptops I sold didn't come with hard drives or batteries when it was clearly mentioned in the listing.  eBay told me too bad.  Buyers don't have to have a valid reason to get their money back.

But in this case, the buyer did have a valid reason to get their money back.

 

They were told the phone was fully functional aside from the IMEI, but it was not.

You are so right.

 

I buy a frying pan on eBay,

 

I cook fish in it and burn the fish.

 

Is it defective or am I a bad cook.

 

If I say it is defective I can return it for a full refund and not even wash it.
