Selling Medical Devices

I'm confused. I recently listed a medical device Ebay removed because it said selling medical devices is forbidden.  I actually used a listing from a sold device as my draft.  Many of these same items were listed AND had sold.  What's going on?

Well it looks like you got caught? I had two listings recently for nasal pillows for a cpap mask. One listing was for a size Small and a size medium. In two days I sold the medium size and all went well. A day later I get a message from ebay that my Size small is prohibited. Go Figure? I believe medical devices are a prohibited item for sale on ebay.

Medical devices cannot be sold here.

 

Your listing got caught by the BOTs and pulled. The other listing didnt get caught.

Dont relist it. Once on the BOTs radar they watch you closer.

Please make sure you do not relist! It is a one way ticket to getting a permanent suspension eventually.

@cleanouttheatticAs others have said, you got caught, others didn't. Below is the page regarding selling medical devices. Maybe the other person had theirs listed in a different category, or you may have changed a few words or details that caused your listing to be flagged. Towards the bottom, it details all the extra info you need to include on your listings that are not required on non-medical listings.

 

It's important to check that items can be sold on eBay before they are listed.

What is the policy?

Any medical device that requires a prescription can't be sold on eBay, including:

  • Continuous Positive Airway Pressure machines (CPAP), along with masks, humidifiers, heated water chambers, and heated tubing
  • Electrical Muscle Stimulation (EMS) units, and any accessories that require a prescription
  • Transcutaneous Electrical Nerve Stimulators (TENS), and any accessories that require a prescription
  • Oxygen concentrators, compressors, or conservers, and any accessories that require a prescription
  • Flow generators
  • Bone growth stimulators and invasive bone drilling and expansion tools, including osseodensification bur kits
  • Nebulizers and their accessories
  • Pulse oximeters that require a prescription
  • Implantable devices, such as pacemakers, heart valves, vascular grafts, ventricular bypass devices, and implantable infusion pumps
  • Hearing aids that require a prescription 
  • Contact lenses (including "zero powered" or cosmetic lenses)
  • Glucose monitors that require a prescription
  • Needles, with or without a disposable syringe, and items that have passed their expiration date 
  • Covid tests, even if they are over-the-counter

There are restrictions on the sale of the following items:

  • Listings must state in the item description if the device has been opened or used:
    • Used items must be properly cleaned
    • Used items must not be altered in any way that changes the performance or safety specifications of the device
  • The item description should clearly state the product expiration date
    • Items must reach the buyer before the expiration date
  • Some medical devices can only be sold with government authorization. Listings for these items must follow the rules below:
    • Items must be listed in the Business & Industrial > Healthcare, Lab & Dental category
    • The following information must be included in the item description:
      • The seller's name, city, state, and telephone number
      • The seller's business name, if applicable
      • A statement that the item has been cleaned and handled in accordance with the manufacturer's instructions
      • A copy of the following statement:
        "The sale of this item may be subject to regulation by the U.S. Food and Drug Administration and state and local regulatory agencies. If so, do not bid on this item unless you are an authorized purchaser. If the item is subject to FDA regulation, I will verify your status as an authorized purchaser of this item before shipping of the item."

The following items can be sold:

  • Over-the-counter (OTC) medical devices
  • Vintage or collectible medical devices, but listings must state that these are not intended for use
  • New disposable syringes can be listed, but needles cannot be included

Activity on eBay is required to:

  • Follow all applicable laws
  • Respect the rights of third parties
  • Follow the eBay User Agreement
  • Follow this eBay policy

If activity doesn’t meet these requirements, eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: administratively ending listings or canceling transactions, hiding or lowering the placement of listings in search results, lowering seller rating, restricting buying or selling, forfeiture of fees, loss of buyer or seller protections, restricting access to member communication and rating tools, removing feedback, and account suspension.

Where medical devices are concerned, you may need to be an authorized dealer/vendor.  Also, you may need a prescription for certain items.  Check into it.

What's going on is that with 1.5 billion listings, eBay policy enforcement is not necessarily comprehensive, timely, or accurate.

 

eBay policy says that if you violate policy, there may be consequences. And nowhere does it say that using "Sell Similar" automatically makes your listing compliant with policy.

I keep seeing this and i cant find an answer anywhere for the part specifically "I will verify your status as an authorized purchaser" How would i, a seller, go about verifying that the the purchaser is authorized"? i Have circuit boards, monitors, control panel, etc. from some medical equipment (gendex dental xray machine, film developers, ultrasound machine, etc) that has been tested and working, but im not sure how to properly go about selling them. the last thing i want to do is get in trouble for doing things the wrong way.
