I sold an iPhone as "damaged and for parts", but the buyer has requested to return the item, claiming it was "not as described" because he claims the iCloud account is still active. I don't have access to deactivate the iCloud account, but the intention was selling it for parts, not to be used as is. Is the buyers request legitimate and if I asked eBay to step in do I have a chance with the request?

A seller will never win an INAD case with eBay.
Accept the return and provide a return shipping label for the buyer and once you receive the item back you refund them.
Just FYI - As is, means nothing on eBay, but also the 'cloud being active' is irrelevant to the reason you sold the phone, your buyer is a tool, so at least this way he doesn't get to keep it which is no doubt what he is hoping for.

Did you disclose in the listing that the icloud was still active? Am guessing no.....Buyer knows that too. It is just an angle to file the SNAD.
Advise your Buyer to return, as sold, to you for a refund.

If you didn't mention the iCloud account in the description, it's not as described and a good reason for a return.
You can ask Ebay to step in if you want a defect and take a chance on loosing the phone and having to refund the buyer.

If I allow the return is the eBay fee reimbursed to me or do I eat that as well as the return fees?

You will get you fvf back if the return is done via eBay's return system.

If on Managed Payments, in addition to the cost of the label, you'll have to eat the 30c fixed transaction fee. But you'll get the rest back.

If you're on Managed Payments, you'll get your fee's back, minus the $0.30 processing fee.
If you're being paid through Pay Pal, you'll get your Ebay fee's back, but not the Pay Pal fee's.
Yes, you have to eat the return shipping charge.
