Scammed by eBay

So I will try to tell my story as simples as he gets, so I’m the seller of this problem.

 

It all started when I sold a item for 1.6kUSD on eBay, I sold the item I created the tracking number in Portugal CTT carrear, and sent the item, everything went fine until the client started to not be patient, normally it takes 20 or 25 days to a item gets delivered to Portugal to USA, so he opened a cases! When the case was opened he started telling that the item didn’t got delivered, so I started my research with CTT and USPS!
What happened was simple CTT couldn’t refresh or get more information about the tracking number so when people research the tracking number on the website only appears when was sent to USA no more information, so I started questioning “where is the package” well went to costumer support on ctt and what they told me was that they have the proof of delivery of the item (and that would be enough for me to get the case done at my favor). The case was closed at the buyers favor and then I seller disputed the case, and send the proof of delivery and explained the situation that is happening with the carrears! 
the case still closed at the buyers favor, my hands were tied at that point, couldn’t seek any help! Authenticity team, tried to send the case to a Manuel correction but wasn’t success because they told me that i have after the decision 26days to get the proof of delivery and I sent them after the 26 days and I was not true, ebay has all the fills and I do, and they keep telling lies and lies, the response that they give me is to try outside ebay to get this done at my favor! 

I need legal actions on ebay, can some one help me regarding on this case? 

trying to get help from them but eBay at this point is not helping.

 

note: I add a similar case with the same problem and was closed at my favor! 

and the another question is why this one wasn’t… 

 

the another reason they told me they didn’t accept was because of the assignature “it’s says UPS STORE” ofc it says ups store was the address that your cliente (aka my cliente) gave eBay for me to send! Makes no sense this statements from them! 

hope some one helps me regarding of this issue. 

simples math 1+1 is 2… 

 

proof of delivery from usps and ctt and everywhere is money on my account…

As far as I know, to get seller protection you must have proof of delivery and signature confirmation that is viewable online at the carrier's site using the tracking number you provided in a timely manner.

 

It sounds like you did not provide proof of delivery and signature confirmation that is viewable online at the carrier's site using the tracking number you provided in a timely manner. 

 

Therefore, you have no seller protection.

 

Sorry, I have no advice about how to get eBay to waive their policy and refund you.

Then why not help out the OP by communicating with him in Portuguese.  I assume your Portuguese is better than his English (although his English is really quite good, I think).

The problem is that online tracking is not showing the package was delivered.

It doesn't really matter what the carrier provided, if Ebay can't look up the tracking number and see that it shows delivered, there's not much you can do.

The signature and the proof with the actual tracking number was provided correctly with the correct timeline, eBay is just trying to manipulate reasons and reasons to not refund the 75% of the item sold.

 

I have proofs that I provided the proof of delivered in time, was when I complained on the first decision of the case! 

you guys don’t even know. I could ofc explain better in my home town language “Portuguese” but I’m trying my best to let this all out, I forgot to tell that in my first case with this similar problem I got a call from eBay regarding on that case (first one) and he told me that was going to get closed at my favor and I even talked about the case that I lost this one that I’m taking, and he told me that I just needed to provide the proof of delivery and I did… and explained the situation. 

And even then was closed at the buyers favor. Does actions and the decision makers have no clue what they are doing at this point.

How can u say my item is still selling sense I can have many other items worth that much, does arguments makes no sense.

I already talked with usps and ctt they don’t responsabilize, but I will try to contact them again and to force some actions regarding this issue, as I told everyone and the first statement, I contacted them if they could manually update the tracking to delivered online. But the answer was they can’t.

Yes got the signature but was from the ups store, because the address of the cliente was to a ups store.

Your English is perfectly fine.  It's better than some we read here which is written by people whose cradle tongue is English.

 

The problems we're having in trying to help are: 

 

This is a complicated problem, involving two carriers (CCT and USPS), and it remains unclear what tracking information is available on-line and what is not available.

 

There may be differences between the U.S. platform and other international platforms that we don't know about. 

 

At one point, you mention the "Authenticity team."  Does that mean this card went through the eBay Authenticity Guarantee program?

 

As for legal remedies, which you mentioned, taking legal action against an American company would be costly, if even possible;  plus, under the standard eBay User Agreement, you waived some legal rights.

If I could prove what they are telling me via phone would be great, I litterally contracted usps and the supervised from usps even told me to contact the eBay authenticity team and fuse calls so that they could explane to them the situation. 

Yes I wen to that program and was not accepted from the department of manual correction.

I have never tried it myself, but many people here have said that they get good help by contacting eBay for Business on Facebook.  Maybe you could try that.

My last comments on this.

What you have not answered for the crew here:

1) Did you pay for signature conformation

2) Did you purchase insurance

3) Did you use the Ebay EIS program

4) Did you ship independently

5) Why did you not use a faster delivery service w/signature & insurance

6) Did you upload the tracking # to the order right after you shipped it

Now with that said, if you would have paid for the signature & insurance you would have the ability to file a claim or obtain all of the documentation instead of trying to piece mill this together. It shipped to an UPS store front via USPS. I doubt UPS signed for it maybe they did. UPS/FedX/DHL/Postal Mail Centers will ask the customer for an identification to verify the person picking up is the person receiving the package and in numerous cases have them sign for it. I bet you are unable to see a signature for delivery from the customer. 

Did you claim the total value of the shipment for import duties & taxes if you did not use EIS? 

You claim you have a signature? Who signed for it the UPS store or the customer? If I did not receive a shipment for 20 days, I would have canceled it. If you used a faster delivery service, you probably would not be in this situation, correct?

You really need to reevaluate your shipping strategy on these high-priced items.
