I sold a product to a guy in Hawaii, bad mistake, it got delayed on a boat but he confirmed it was on its way and then requested a refund which eBay obviously gave him and kept my item, that's fraud and eBay is an accessory to it, they knew it was going to get there and gave him his money back, this company is **bleep**, how does someone start a better platform for selling other then this shady company.

Sorry this happened to you.
I'm in Hawaii.
Not everybody knows (including ebay) that some forms of shipments to/from Hawaii come by boat and can take up to one month.
I recently has a customer select "media mal:" for his DVDs. The estimated time frame ebay gave for delivery was ridiculously low. I forget exactly what it was. Two weeks?
If you're shipping First Class or Priority Mail to Hawaii, no problem.
I hope you don't blame "Hawaii" for the problem you had with this one transaction.

Some missing information in your posting. Did the buyer open an INR case and if so how did you respond? Did they do a chargeback and if so how did you respond? Generally eBay doesn't just simply refund a buyer without some type of seller interaction.
Not sure what you sold there is nothing under this account which has only been active for about 6 months.

Sorry this selling effort was difficult. This outcome is one of the risks eBay sellers take when listing here.
If the buyer opened an Item Not Received case, and the package was in transit, having shown movement within the last 10 days, you might have been able to get a temporary extension from customer service to buy some time for the package to reach his destination. (What method was used to ship the item that it ended up on a slow boat?)
However, if the 30 days for filing an INR was nearly up, and the package was delayed, the buyer is within his rights to press his claim. This is spelled out in the eBay Money Back Guarantee and every seller agrees to it before listing their first item.
So it is not fraud, given that you accepted the terms of use that enabled eBay to refund your buyer when a case is opened for Item Not Received (or not As Described). All that can be done now is to contact the buyer upon delivery and re-invoice him, hoping he is honest and will repay.
By refusing to refund the buyer voluntarily, eBay likely leveled a defect on your account. The only way to win an INR is to show proof of delivery with tracking. Agan, very sorry this happened to you.

First class, Priority & Express Mail services reach Hawaii quickly. What shipping method did you select? If you now have proof of delivery, just appeal the INR decision, upload a screenshot showing that the item was delivered to the customer in Hawaii & ebay will refund you the amount of the sale.
Hawaii customers are cool. Just hang in there! Aloha!!
