I am trying to understand how as a seller you can completely be frauded by a buyer and the proof is 100% in my favor. And beyond that the person tried to get another item from me that I have never had. So essentially ebay is telling me I am wrong? No this is what is wrong with our world.

You sold a Thing.

The buyer did not receive it.

Was it tracked?

Tell him to open a Not Received Dispute. Enter your tracking number showing delivery in the dispute.

You win, the complainant loses*, he cannot leave feedback.

The buyer says it was Not As Described.

Tell him to return it for a full refund.

If he wants you to pay return shipping, tell him to open a Not As Described** dispute.  You may or may not have to pay for return shipping.

When you get it back, refund.

You can demand a return even if you have a No Returns policy.

No Returns does not mean No Refunds.

 

It's business, not personal.

 

 

 

*Even if the Thing was stolen by porch pirates, if the tracking shows delivery you win.

** Review the original listing. Was the "other item" in a stock picture? Mentioned in the description copypasta?

It actually very easy to understand. 

 

eBay has overwhelming evidence that despite this happening regualrly for more than a decade, millions and millions and millions of sellers have continued to list billions and billions and billions of items here. So I suspect that eBay has decided that if fraud becomes too much of an issue for a seller, the seller will leave. 

 

The good news is that for very little money, any seller can set up his own website where he can accept only cash and set the rules for how returns are handled.

eBay does not consider PROOF of any sort.  The buyer does not have to offer any when making a not as described claim, and the the seller's evidence will no longer be considered in any dispute.   Basically, the results are dependable and predictable as soon as a buyer hits a "not as described" button.  

The entity that controls the money, determines the outcome.  Though the terminology is phrased a bit differently in the eBay user agreement, you agreed to be a victim of buyer fraud when you signed up to sell here.

Except now when they file a not as described,  you can accept or dispute it.  If you dispute it you are not allowed to use words, just pictures (could take a picture of your words I guess), however,  you can't offer full refund upon return.  It is some 3rd party **bleep** that is really shady and to top it off, you can't leave a negative feedback to warn other buyers of their scam... you have to leave a positive to post they scammed you!

You are describing what happens when an item not described claim is filed as a credit card chargeback or payment dispute. When the claim is made through the ebay MBG you do have the option to have the item returned before you refund.

More practical is to demand the return of the disputed item, preferably including the original packaging if the claim is "damage in transit".

The seller pays for return shipping.

Even if the seller has a No Returns policy, they can demand the return of the item.

Will the cost of shipping both ways be greater than the value of the item, if it is returned in the original state?

It has been the habit of china and glass dealers in particular, to accept a photograph of demolished purchases, rather than demanding the return of unsaleable shards.

 

Do not mix up

  • eBay's Money Back Guarantee, which allows 30 days from Delivery for Claims
  • with the chargeback provisions of the buyer's credit card which vary from card to card.
  • Nor with the Buyer Protection policy of Paypal, which allows 180 days from Payment  for Claims, but requires the Buyer to return the disputed item at his own cost before refunding.

The problem with that is that you set up a site and people won't buy.  They don't trust.  I am not saying anything bad about you, don't get me wrong. But how do you drive folks to your site?

People will try to steal anywhere not just online, but there are many more risks online. Mainly the credit card chargeback. If you do all the preventative measures to avoid a chargeback like allowing returns, giving fairly long return times like 30 days so they do not run to their charge card when ebay or you say times up too soon, and when you give them a free return shipping label you cut your risk factor.  You try always to work with the buyer but sometimes a buyer can very extremely unreasonable. I have one now that is demanding to keep a 200 dollar item we sent in mistake. The case might be won on ebay but the buyers can run to the credit card when they do not get their way. I have one that did a payment dispute for not received and tracking showed delivered so we won that one, then the criminals go back and reopen another case with the CC company for not as described. These determined criminals will stop at nothing. It happens.

If this is true, a class action lawsuit should be in order.

 

A company's set of policies (which ebay has) that in fact, encourge and promote buyer fraud (ie illegal activity of theft using interstate transportation, ie rico violations) probably will not do well in the courts, and will also be bad optics for the company.

Just because "its policy" doesn't mean it can somehow not be illegal or promoting illegal activity to occur.  Its like "I was just following orders" may be a rule, but it isn't a legal defense for doing horrible immoral inhumane things to people.
