Random Refund, Letter From USPS, Help?

I purchased a packaged that arrived busted open with water damage to the box and inside the package itself. We set it out in the sun for a while to dry out the water and set the damaged box aside, given the item was falling out of the package when handed to us at the front office at our complex. When messaging the Seller and sending photos of the damage, they requested that we go down to USPS for inspection and file a claim. We were told that the Seller instead should file the claim and when informed by USPS, take the package down for inspection.

 

Given USPS throws out the package after inspection and depending on whether it has been approved or denied, we didn't want to risk receiving less than the price we paid for. We also didn't want to risk losing the item in case it needed to be shipped back, given the Seller denied our request for a refund.  A few days later they randomly refunded us saying they would speak with their manager and we never heard anything since May 28th. They never followed up or requested additional action needed. 

 

After weeks passed my partner was concerned about mold growth inside the box and had opened the item in my case, given we haven't heard anything back from them. We just got a letter today 6/6 by USPS that was issued on May 31st, requesting a package inspection and customer reply stating "If you have not reported the damage/missing contents to your post office, you must do so immediately." Issue is the box has now been opened. I've been waiting for the Seller to respond and heard nothing, case was closed so I assumed it was over. 

I still have photos of the damage when I picked it up from the office however, we no longer have the damaged box. Where do we go from here?

Go to the post office with the letter, the photos, and whatever you have left (the item?)... tell them you went down there weeks ago with the package and they said the seller is the one who had to file a claim. Explain that you since threw out the package for safety reasons (mold).

were you refunded? if yes all is good move on. if not open a case with ebay. sellers responsibility to file a claim with usps not yours. sucks for the seller because its a usps mistake but if they haven't filed by now they are not going too.

she was also refunded with no contact from the seller. then they contact them and demand to take it all down to the post office after what three weeks? this is above and beyond whats expected of the buyer. its now a seller usps problem they need to figure out buyer is done they are way to nice to have gone this far with it.

It sounds as if the OP didn't open an eBay case, but wanted a refund from the seller which the seller refused, and then changed his mind and refunded anyway.

It is beyond what should be expected of a buyer but I had the post office require this in order to pay a filed claim.  The receiving post office had to sign off on the letter requiring inspection.  I do not know what happens if a buyer refuses to comply or packaging is no longer available though.  I would think the photos should be sufficient regardless.

How many weeks did you leave the item to dry in the sun?  The MBG has a 30 day time limit.  Did you follow the procedure and request a return because of the item not being as described within those 30 days?  Dealing with a USPS claim would fall on the seller.

Jeez louise people.  I know I'm bad to skim but this is ridiculous.

 

The letter was from USPS. Not from the seller.

Here on the boards @rainbowlavaz we always advise the seller to refund the buyer, then seek a claim with the carrier, using cooperation from the buyer.

Wow thank you for the response, I thought this would possibly go unanswered.

To give more detail..

 

When I contacted the Seller and sent them photos of the damaged package busted open (Looked like a truck ran over it) they placed all blame on the post office and told me to take it up with them, not their problem. I then proceeded with opening an Ebay claim for return, but the Seller refused and kept repeating "Take it to the post office and open a claim. We unfortunately cannot approve your return or request for refund." I asked them countless times to open a USPS case on their end and I would take the item to the post office for inspection after they guaranteed a refund or to return the item. They still refused..

 

I was told through Ebay when calling that if I were to take the package to USPS prior to receiving a refund, they would dispose of the item and this could void my protection through Ebay, should the item no longer be in my possession. I was also informed that if I were to open a claim through USPS, it can be denied or I could receive less than what I originally paid. They said the best option was to open a return, so the rep opened a case and included details. I sent the Seller all the photos I had of the damaged package and item.

 

A week passes so I contact Ebay, they inform me that because the Seller is out of Country, that I would have to wait 5 days for them to provide a return label. If they refused then the case would be closed in my favor, given Ebay cannot provide return labels for out of Country purchases. After days of waiting since my last call to Ebay, the Seller randomly issued a refund and said "We have contacted our manager and will inform our post office that you refuse to file a claim or take the item in for inspection." Which I never once refused... The return claim was closed after they issued a refund and I didn't hear from them since for over 2 weeks. 

 

We had set the package out in the sun prior to bringing it in the house for 2 to 3 hours. Given we never heard back, we assumed it was over and they didn't want to work with us anymore. My partner said he didn't want to leave it wrapped up with moisture possibly inside the item box, in case there was mold growth and he suggested either opening the box or throwing it away. He went ahead and opened the box instead and threw away the package because it was smashed and saturated with water/dirt.  That was over a week ago that we opened the box. Then today he walks in from work and says I have a letter from USPS stating

 

"Customers are required to present the damaged article, mailing container, wrapping, and any other contents received to any post office for inspection immediately. If you have not reported the damage/missing contents to your post office, you must do so immediately. Please complete the reply section below and return this letter to us by fax or mail within 3 business days. In order to respond to Japan, we must know whether or not you received this article in damaged condition or with some contents missing." 

 

So my question was, since we don't have the package anymore and threw away the box, wrapping, ect, all we have is the damaged item, what should we do now? Do I just ignore the letter or tell them that all I have left is the photos? I can give them the item to inspect and toss, but the package and proof of damage is gone. We also gave the Seller all the photos we had that showed clear view of the damage.  Anyways I greatly appreciate everyone's help on this! Sorry for the long post!

The advice you received from customer service throughout the process was accurate. The answers to your "what should we do now" questions are in my above post.

 

It's not unusual for insurance claims to take up to 4 weeks in my experience, depending on the claim. I understand from the seller's messaging that it sounded like the matter was over with, but I probably would have messaged the seller and reiterated that I was willing to cooperate with an insurance claim and if that wasn't necessary they should let me know by X date otherwise I would throw the package away because of safety concerns.

 

This was an international shipment so that could also impact the length of time for the insurance claim to be processed.

 

I think bringing the item and photos should be enough for the carrier to process the claim. The carrier will probably have you sign a document confirming the damage claim. Do what you can to cooperate with what you have and from that point forward it's between the seller and the carrier.

You don't have to cooperate with the USPS insurance claim but if you don't, although the seller did not proceed appropriately (many don't know the policies or understand the problems when you have both a return SNAD and a postal insurance claim at the same time, which takes priority and how)   you did ultimately get made whole by the refund.

 

If you ignore the letter, the seller will likely not be able to win the insurance claim and will not be made whole by USPS, despite his being rightly entitled to.  Your cooperation, while voluntary, could ensure that he is refunded.

 

Personally, I would try to cooperate with the USPS claim to the best of my ability.

 

For future - should this happen again, I recommend being less concerned that your home will be overtaken by mold and instead put the packaging in a safe place awaiting contact from the insurer.  It's not the seller's fault that there is lag time and silence between when a claim is submitted and when the carrier contacts you.  I wouldn't have thrown it away just yet, personally.

 

But then I had a postage insurance claim that took a full 6 months to settle, so I'm chock full of patience on that front.
