Another buyers purchase and he will keep the item and sale it refuses to respond to any messages now I had to refund the buyer of that item 250.00
It's so unfair

And the question is, if the item does not have the language required in b) is it still considered a gift, or does that leave room to rectify an error made in sending it at all. Beats me. As I said, I'd like to see some case law.
In the meantime, I'll order a calendar from the MOMA and hope to get, instead, the original of one of the paintings featured on it. 😄

NA, there are amazing people everywhere. I wouldn’t think that we are less moral and ethical than we were 100 years ago. People see what they want to see, and block out what they don’t . Whatever fits a narrative or something convenient. beauty is all around, and, sure, there is some ugliness, but there always has been. Focus on the amazing folks all around us 🙂

Threatening mail fraud is exactly one of the reasons this law exists as companies sent merchandise unsolicited and required payment with threats. Since the law exists threatening mail fraud would probably amount to harrassment

@jagonz-3818 Sorry this happened, I have only skimmed the many replies so forgive me if this is a repeat, but the buyer that refuses to send the item back needs to be put on your Blocked Buyer List.
Do that right away.

Sorry for your mistake.
One suggestion....... DO NOT at this add the buyer to you blocked list.
Be sure that it is not .................. for sure........... ever going to be returned.
Per the latest eBay policy, (unless there has been a change) adding an ID to your BBL blocks communicating from that ID even when the seller does not check the box to block communication.

If it was me I'd be telling the wrong recipient I'd be filing a case for mail fraud, but if they care to do the right thing before that action I'd send a prepaid return label.
There is NO mail fraud here if the package was addressed to that buyer. They CAN return the incorrect merchandise if they want, but they have zero legal obligation to.
