New opened item rejected by buyer, next steps?

I just wanna check with people before filing an appeal.

I put up a listing for a new, unused gasmask filter under collectibles>militaria. It's out of the packaging but any usage would show marring of the plastic threads, so I put it down as "new". All my photos show the bare item, zero packaging. My description states "like new, open-box", and "no paperwork included" which might not have been the best wording for it, but still.

Buyer gets it and says that it isn't in the factory packaging, sends me photos of what it "should be like" (photos of different filters, packaged in different ways), complains that he doesn't trust using it on his kid's gasmask (my dude, not only is it a warzone-grade filter, it is under collectibles, not industrial safety!) and demands a refund. I give it to him because I feel it's fair enough. I lose like $15 on shipping the thing, and get a negative review.

Should I pursue the Report option? Specifically, "Buyer made a false claim > Claimed the item was not as described when that wasn't true"?

Just refund your buyer without requiring a return. There is no reason to report the buyer. Next time toss something like this.

Honestly just doing the no-return refund would've been the smarter choice, financially.

Yes. Also there was a conflict in your listing, Item Specifics said "Brand New" and a buyer using their phone might have not seen your description.

eBay does not  have a definition for "Like New" just sellers do.

First, it wasn't NEW. It was not sealed in package. You misrepresented the product you sold. Doesn't matter the category you sold it in, it was not NEW.  Only factory sealed packages qualify to be listed as new. Anything else would be a false description.

 

Secondly, even if you had listed this as "no returns", there is NO such thing as NO REFUNDS on eBay. eBay's own policy allows for at least 30 days, and CC companies allow up to 180 DAYS. Let that sink in. I mean it, does NOT matter what you sell here, there is NO such thing as no REFUNDS. You can sell something "parts only" and you may still have to give a refund. There is NO seller protection for refunds. 

 

If you want to find selling success here, the first thing you need to do is change your attitude. List your items right, or you are going to face more frustration like this.

You made an error by listing it as new.  You need to read eBay's definition of "New".

What would be the reason you'd report the buyer?

That's deceptive.  There are multiple pictures of boxes and packaging.  When you sell on eBay you have to assume every buyer is shopping on a phone with really tiny pictures that can't be enlarged.  Not to mention your choice for print in the description is too hard to read, most buyers won't even bother.

When a listing has conflicting information about the item condition like yours did, eBay will not see the buyer’s claim as abuse so there’s no point reporting them. Cut your losses and move on. You’ll be in a better position for your next listing now that you’ve learned something not to do.

Are we looking at the same listing? lmao. It's two photos of the bare item. Like I already know I'm in the wrong here but you don't have to make more stuff up. And good tip on the description, I don't format it at all but I'll start using a header size for the whole text.

Thank you to everyone. I do wish eBay had a formalized Open Box condition, but I'll err on the side of caution and list my stuff as Used unless it's physically, factory sealed.

It wasn't a false claim, the item was listed as new, when it wasn't.
