New Adult Content listing restrictions

The new adult content restrictions on eBay are archaic and embarrassing. What was the purpose of this change? Who is this policy really supposed to protect? The company already had two or three step adult filters and disclosures before someone could view the cover of, say, an x-rated magazine with a explicit cover. This policy is RIDICULOUS. America and it’s companies need to get over it’s sexual hang ups and stop buckling to people and groups complaining about something they really don’t have to view. Is this not 2021?

Agreed. And while ebay's new rules are confusing , so are etsy's (although, to etsy's credit, less confusing). But I think the aim here is to end up more like etsy when it comes to mature content---no more walled off porn section, but "mature content" (not porn) within the main section is OK. I've said before, it will take a while for the dust to settle on this issue, but in the end I suspect kitschier stuff like 1950s mens magazines and pulps, nude art, and so forth, will still have a home here. Mainstream films with some sex scenes will be OK. But the stuff pretty much everyone would call , well, porn....no, not going to be allowed. 

 

I've asked the Weekly Chat team a couple times to invite the Adult team to come to Weekly Chat and explain the new rules (and listen to some seller suggestions) The Chat team likes the idea, but that doesn't mean it's going to happen. 

 

At this point, I think sellers need to accept that porn is going away, period. Asking "why" ebay made the decision stirs discussion, but serves no useful purpose. Going forward, the real question is: just exactly what is allowed and what isn't? This is the real question. Sellers don't want to violate the rules, but sellers need some guidance. I think we can all accept that it would be impossible for ebay to provide a detailed list of every item that is acceptable. etsy acknowledges as much in its rules. But as written now, the rules are confusing and it appears they are being applied haphazardly. ebay really should provide more guidance.

WHAT WOULD LARRY FLYNT SAY.. 

More and more we are losing are freedom and expressions as Americans. This act is un-American. We should have the right to sell anything we want within legal guide lines, but then again this is ebays market place and it is a global market place. Items like these do make us special as Americans. It shows our freedom as a nation.. This can't be denied. Once we give up up our rights and freedoms what do we have.

They specifically list some, and they imply that as long as the listing itself does not contain nudity, it should be ok.

"The following are examples of magazines and books that generally do not contain sexually explicit content and can be listed in the Magazines category as long as the listing does not show nude images: Playboy, Playgirl, Playguy, Mayfair, On Our Backs, Butt (magazine), Blue (magazine) Gayletter, Fantastic Men, or Penthouse"

Now this is the source of the biggest confusion.  What magazines are allowed and not.    I have had "ADAM" magazines from the 1950's and 60's continually removed by Ebay.  They claim it is porn.  But Adam is about as Tame as you can get in a magazine.  They list Penthouse and Mayfair as okay, but they are far more explicit than Adam.  When I talked to them on the phone, it was useless trying to explain the difference.   The rule is just too confusing and arbiter and should be revised.

Yeah, I think eBay has in their minds their old rule that only pre-1980 Playboy and Penthouse and Mayfair were OK. If you look at Penthouse after 1990 it became as raunchy as any on the market, yet it's still apparently allowed while many tamer magazines (and DVDs) aren't

Don't confuse freedom of speech with businesses rights to determine what they will and won't allow to be listed.

 

One keeps the government from telling you what you can or can't say/, publish ect and the other has the legal right to remove anything they deem inappropriate.

"AS I DID MENTIONED EBAY DOES HAVE THE RIGHT TO SELL WHAT THEY WANT IN THERE MARKET PLACE' I STILL THINK IT'S UN AMERICAN AS THIS IS BECOMING A GLOBAL MARKET PLACE. SLOWLY WE ARE LOSING OUR FREEDDOM AS A NATION. ITEMS LIKE THESE MAKE AMERICA UNIQUE. THERE ARE OTHER MARKET PLACES THAT ARE POPPING UP EVERY DAY WHERE THESE ITEMS ITEMS ARE STILL  ACCEPTED.  AT LEAST WE STILL HAVE THAT CHOICE. THIS IS ANOTHER CASE WHERE EBAY IS LISTENING MORE TO THE BUYER THEN THE SELLERS. IF YOU WANT TO TALK BUSINESS.. BY THE WAY SEX SELLS.

There are lots of things that are legal, but not allowed on this site. Puppies for instance. Legal to own, but they can’t be traded here. 

This is not a restriction to your freedom. Neither is the decision to no longer have an adult only section. 

You are FREE to do some digging and find those websites that do allow the items in that category. 

You best hurry though. I would imagine the sellers who were ahead of this change are already on those sites, establishing themselves. 

While you are still here, it may be time to invest in a new keyboard. The one you have seems to have the caps lock key stuck.

YES IT'S UN-AMERICAN.. JUST LIKE DOWN UNDER. BUT ITEMS LIKE THESE STARTED IN AMERICA AND ARE SLOWLY BEING TAKEN AWAY ALONG WITH OUR FREEDOM.

I believe ebay wants the rules to be confusing and vague on purpose. Other policies here are vague as well...black Americana and Native American policies are confusing too, does ebay update them...no. It's done on purpose so they can punish at will. 

 

It the old guilty as charged first, then they tell you what policy violation you broke later method of enforcement.

 

In real life, Americans can't be guilty of something unless you break a law, however, that law needs to be clearly on the books and needs to be very specific in every detail. The only exception are obscenity laws, which are purposely vague and have been forever.
