I am the last person who would complain about a fellow ebay seller, but I got a defective item I cannot use. At first, I was going just let it go, as the price is not that high. On the second thought, what I received was a total garbage, and the seller should had known that. Ironically, I even paid a bit more to buy from the US seller when Chinese ones offered for less (not considerably less, but I wanted to support a seller in the US-most likely, this garbage is from China, and the seller is only registered in the US).
So, I opened request to return with the reason "defective". The seller has "30 days return, buyer pays shipping". Most likely, he is a top volume seller. I haven`t heard from the seller yet (feedback suggests that he doesn`t respond, and has 27 revised negative feedbacks as well - I haven`t left any yet).
What should I do next, and do I have to pay return shipping if the item is defective? Also, the seller used Media Mail to ship non-qualified item, which is another story.

I am surprised you have to pay to return a defective item. Maybe others will explain why. You probably should discuss this with eBay.
Return the item to the seller. Once the seller gets it, they have to refund you. If not, eBay will step in and refund you. If you have to pay for the shipping, you will have to decide if it is worth it.

If you filed an item not as described case (defective falls under this umbrella) and the seller does not send a prepaid return label after three days, on day four an "ask Ebay to step in" link will become available. Click that and Ebay will either send you a label or they will force the refund without return.

I don`t know if I have to pay for shipping - that is what his return policy states. The seller has till December 29 to respond. But like you said, I shouldn`t pay for defective item. And, since the seller used Media Mail to ship 2lb+ for something that is excluded from eligibility, return shipping by correct method is not $4 he paid to ship, but $9.

Sorry, I thought I read it as eBay saying you had to pay for the return. The seller has to pay for the return and send you a shipping label. Use the shipping label they send. Use an appropriate box, not media mail to send it back. The seller will be charged for the postage. As pointed out by southern tea above, if the seller does not respond after the set time by eBay, ask eBay to step in.

Ok, appreciate it! ebay stated that the seller has until December 29 to respond - I opened the request today, I guess the extra day is due to Christmas.
Also, if he is a top seller and offers 30 days return (not free), can he deduct from the refund? I`ve read this here, but forgot if the 30 days returns have to be free?

If you do not receive a label for the return of the NAD item, (I think within 4 days?) go back to your case and ask eBay to step in.
They will force the refund and you will get to keep the item - it is totally on the seller to fix this for you.
The seller has "30 days return, buyer pays shipping". Is over ridden by the MBG in a not as described case
