NEW to eBay - first listing: "Counterfeit items, taken down" Seriously?

I made 3 separate posts for my AirPod Pro's after the first one was taken down after I got an email that it said it was COUNTERFEIT!!!

 

I was like are you serious...

 

I called ebay on the phone and they said they took the post down, and said some pictures were duplicated, and my pricing was off, and description etc., I said okay I will literally take a picture of me with my AirPod Pro's & the serial number and publicly post both, and I did, and got called counterfeit item again.

 

My frustration turned to, "Who the heck is looking and saying that's a counterfeit AirPod Pro's"? I mean seriously, I even told the girl I would DRIVE to the apple store at my mall close by, and could see if they could send over some sort of verification but that I wouldn't know what to say but that I was willing to do that or anything, and the girl from eBay on the phone just was not having any of it.

 

Literally, here are MY pictures of MY AirPods Pro, with ME in it: (I keep thinking why is eBay putting resources towards taking down something counterfeit, that is not counterfeit, and how are they justifying it...)

Apple doesn’t want their AirPods sold here. ‘Counterfeit’ is a blanket reason given when the listing is removed. There is no fighting it. 

Don't list them here. Find another venue. You risk permanent suspension if your selling privileges by defying the email you received.

If you continue to relist these, you will probably get kicked off ebay, forever.

 

Once something is taken down by ebay - the 'bots do it - it is unwise to relist it- ever.  It doesn't matter if CS tells you it is okay and to go ahead because they aren't in control of the 'bots and the bots run the show.  It doesn't matter what the reason is that CS tells you, you can't fix it and it will not do you any good to try to buck the system ebay has in place.  You will more than likely be off the site.

Not saying 'NO' doesn't mean 'YES'.

The foolishness of one's actions or words is determined by the number of witnesses.

Perhaps if Brains were described as an APP, many people would use them more often.

eBay has 1.5 billion listings. No front line minimum wage customer support rep knows how the counterfeit detection algorithms work, knows why it targeted your listing, or has the authority to override the take down of a listing. And eBay is certainly not going to pay them to wait for an Apple store to validate your item.

 

You might as well walk into a branch bank and argue with a teller about why their mortgage interest rates are too high.

 

Here is what the eBay user agreement says:

"we reserve the right to refuse, modify, or terminate all or part of our Services to anyone for any reason at our discretion"

 

If I read your post correctly, your listing was taken down by eBay and you tried to relist three additional times. I am actually quite surprised your post did not start with "eBay just suspended my selling account indefinitely ... "

I believe they are real but I'm not ebay and you are not an authorized dealer of Apple. Good advice already given and there is nothing more to add. Please don't relist or that will be the end of this story.

Are they Apple brand? Or are they generic branded? Did you use Apple in the listing? 

If they aren't made by Apple, you can't use Apple in the title. 

 

If they are Apple and if they're authentic and made by Apple, it doesn't matter whether Apple wants their items sold on ebay or not. First sale doctrine allows the sale of genuine items. 

 

But I'm curious about how they were listed and described.

If it's any consolation, you are one mighty good lookin' fella.

 

Had ebay allowed this sale, you'd get extra clicks if you chose to use that photo as your gallery photo.

Not worth the fight.  Probably real.  But I have been sued by a big name company for relisting things I thought were ridiculous to take down.  Facebook marketplace....Who is this guy lol...nadda items, nadda feedback.

It seems to me if this were a complaint by Apple,  there would have been a Vero notice. If it was NOT a Vero takedown then something else is going on.  

 

At any rate, even if it is real, I would not relist it on this platform. Once the mighty eBay bot declares counterfeit, it "becomes" counterfeit for eBay purposes,  even if it is not.

So many authentic items are being taken down due to the fact that there are so many counterfeits out there.  Chances are a bot tagged you via a word or phrase in your listing.  I believe your item is authentic, however due to the nature of the removal, I wouldn't try to re list it as ebay could suspend your account and given the fact that you refer to these boards for advice tells me you are trying to be a credible, good seller. Your photo's are great and you did everything right as far as the listing goes.   Unfortunately, because of other bad sellers, this has been the result.  Keep trying, keep listing.  😊

If you are in fact a brand new seller and this isn't just a posting ID, take it as a blessing in disguise. These are one of the top scammed items on eBay.

My understanding is that some of the fakes that get into the country are so good you need to be a expert to tell the difference. If you are a new seller (and have multiple pairs?) or even just one pair as a first listing.

Identical looking  but poor quality electronics. Apple should be cranky about that.

 

New seller with Ipods are a big red flag for eBay. I would not buy from you even with your flashy photos with 0 feedback.

Establish yourself and as stated DO NOT relist them again if you value your account.

The First sale doctrine is a worthless piece of paper here on ebay...it has never protected me.

 

Over 20 years I've had a few things removed that were 100% genuine with receipts. 

 

A poster here mentioned that if a company doesn't want something sold on ebay, they just report it as counterfeit whether it is or isn't. This is absolutely true.
