Currently and once the new Seller Updates takes effect Oct, 1st 2019 Ebay will still continue to count NAD's (Not as Described) when Buyers fail to return an item. This bogus policy is only in place to inflate Service Metrics numbers giving Ebay the green light to charge 50% more in fees to all transactions in like category... SHAME EBAY!!!!
I have bought to the attention of Ebay several examples of buyers opening false NAD's where there was clearly no error on our behalf. (Ex. Buyer opens NAD because no shoe box was included yet listing clearly states multiple times New Without Box or Open Box). When we bring the "Oversight" to the attention of the Buyer they usually apologize and decide to keep the item. Ebay however, instead of being happy with a successful outcome, continues to count the defect against our service metrics (Even after the oversight it is brought to their attention).
Ebay's were is your business integrity!!! Allowing these non-return NAD's to count (Especially against Buyer's that offer free returns) is ridiculous. So many times I have seen where Buyers mistakenly fail to fully read a listing only for us to bring this oversight to their attention and they in turn decide to keep the item. Why would you continue to count these bogus returns and impose a 50% increase in fees for something you know 100% was bogus. If the item is not returned (For what ever reason) it should not count... plain and simple!

This is a version of the old defect system we used to work under. In ebay's eyes, just the fact that a return is opened is a sign of a problem and so they count it regardless of the outcome. At least they aren't all counted now as true defects.

That too is wrong... If Buyer fails to return and/or tracking confirms delivery these two "Defects" should automatically be removed. Ebay has the data already in their system to automatically remove these bogus defects. Ebay chooses not to removed these defects from the Service Metrics count in order to charge Sellers a 50% increase in fees. In 3 of the last 12 months we have paid the 50% penalty where if they were to remove just one of these bogus defects each time we would not have had the increase. Their ability to inflate and falsify the data is disturbing. What's next? If a Buyer ask a question before purchase they will count that as a defect too.

Frustrating I know, unfair yes, but a bit better than the old system where a neutral was declared to be the exact same as a negative.
