Filed a case because buyer returned wrong item. Ebay found in sellers favor and issued a refund. Sold burgundy leather Dansko clogs. Customer returned vegan clogs. We attached a photo along with info. Unfreakinreal. Now we get to waste more time dealing with the incompetent customer service.

I would advise you to appeal this case. This happened to me last month and I did have to fight with Ebay to reverse this ridiculous decision. I sent a bad buyer a beautiful Ralph Lauren shirt and he returned a piece of garbage shirt back. This is happening more and more because Ebay allows it. Ebay has become a great platform for scammers. I am sorry this happened to you but if you are persistent, you will win. Good Luck!

If eBay wants to create and enforce policies that permit bad buyer behavior, scams and thievery, then eBay needs to pay for it ... not the victims.
Often, these cases are initially judged by software robots and/or lowly trained customer service minions. You need to appeal the decision to get a better set of eyes on the case.

Definitely appealing. This ain't our 1st rodeo, unfortunately. The kicker is, assuming we never get the original product back, and keep and resell what was sent(buyer has not responded to our messages), the shoes they returned are worth less than half of what was originally purchased.

Plus this is why I go crazy when folks come to the boards with issues like this and the overwhelming advice it to RETURN FOR FULL REFUND. Not only is Ebay allowing this but sellers too. FIGHT it if you think you are in the right. Ebay will not seek a refund from your buyer but they will overturn the decision and credit back your money.

The conversation with Ebay is unbelievable...to refresh: customer requested refund, and sent a completely different pair of shoes back...we emailed buyer, no response...we filed a case WITH PHOTO OF THE SHOES BUYER SENT BACK...Ebay decided case in BUYERS' favor...they refuse to refund our money, and ADMITTED the case was "AUTOMATICALLY" decided, and yes, that's a direct quote...there's nothing they can do, and no supervisor is available...they are "flagging" the customer's account..."you can be assured that ebay is placing a hold on her account', and offered a $30.00 ebay credit...blah blah blah...contacting Paypal now...

OP, what exactly does your photo prove? You say the photo is one of the item that was returned to you, but how does a customer service rep know that? For all they know you are showing them a photo of shoes you had laying around and are claiming they were what was returned so you can block a refund.
When sellers have situations like yours happen, it is hard to say which person is telling the truth. Only the people involved in the transaction know the truth, but a decision must be made. Unless a buyer has a shaky track record or has admitted wrongdoing in eBay messages, why should they believe you over them?
When this question comes up, nobody seems to have an answer that would solve the problem, even I don't. It seems it's either the seller gets cheated or the buyer gets cheated.

The answer is that if you can't get the info to decide these cases- you don't decide these cases. eBay is doing nothing but facilitating theft... because they'd rather solve their problems with YOUR money.

People seem to think the answer to "facilitating theft" by buyers is to facilitate theft by sellers.

Its 1000 to 1 thieving buyers compared to bad sellers these days.....maybe a million to one....EBAY created it.

I will also suggest filing a mail fraud complaint w/USPS - if enough seller did so, it may (or may not) cut down on the fraud/theft.

and many of the bad "buyers" on Ebay are sellers themselves. How does that work in the 1000 to 1 bad behavior statistic?
When things go wrong the law suggests the original transaction be undone. If one party is unethical, how is Ebay supposed to know which one it is, unless one has a track record? Magic? Buyers are going to have credit card protection so one way or another a determined buyer will get their money back. It is just not an option for Ebay to refuse to fix the buyer's problem.
I know the OP doesn't want to hear it but shrinkage is a cost of pretty much every business.
