Maybe a dumb question.... Florida Sales Tax as a seller

I've always had my account setup to charge sales tax. I am located in florida, it's the law i must remit sales tax each month to the state. Now that this new sales tax is in effect. Will EBAY be collecting the sales tax and sending it in to the state, or will i still receive the sales tax from sales of FLORIDA to FLORIDA sales?

Florida became a marketplace facilitator state on 1 July 2021.   So, starting then, ebay will do all the sales tax collection and remittance.   You will still be responsible for reporting and remitting sales tax for the first half of 2021.

     Florida was one of the last states to enact what is often referred to as "Amazon Law" in the wake of the Supreme Court decision in South Dakota v. Wayfair. That law took effect 1 July 2021. However this law pertains to the collection of sales tax by out of state sellers for items sold to Florida buyers. If you have been selling on eBay for awhile you need to look at some of the items you have sold out of state and you will discover that the buyer has been paying sales tax on these items in a lot of states but it is collected and handled by eBay so it is transparent to the seller. If it wasn't you would have to collect and remit sales tax to all states individually. 

     With the passage of the new law in Florida eBay will also collect and remit sales tax, on the sellers behalf, for those sales where both the buyer and the seller are located within the state. Sales tax also referred to as user or consumer tax was intended to be levied against the buyer although it was collected and remitted by the seller. You may want to check a couple of your Florida intrastate sales in July to make sure the eBay changes have applied the new law and they are collecting sales tax on the Florida intrastate sales. If they are you will no longer have to collect and remit the tax other than those taxes you collected from January - July of 2021.

I believe that comment was in response to the "Yes, I think the same as you" post that preceded it. That seems to be the new "go-to" comment for members from a certain part of the world who still think that posting here will improve their chances of being able to sell on eBay. It's replaced golden oldies such as "what is the best payment method on eBay" and "what is the best shipping service".

I recommend that you contact the Florida Department of Revenue to verify how they want you to account for the sales where sales tax is collected and remitted by eBay.  Since these sales would be included in your gross sales figures on your DR-15.

 

Of course, as mentioned by others, you will need to still file you quarterly or monthly DR-15 and remit the sales/use tax owed for the previous periods as usual.

 

Don't forget that you will still be required to collect & remit tax collected on sales other than those subject to the marketplace facilitator law as usual.

Unless you are the ONLY eBay seller in the state of Florida -- I think your state's taxing authority may be able to answer that question for you.  Or if you have a CPA who has helped you with your taxes in the past, he/she would be a good source.

I only sell online, so now with ebay doing this. i will no longer be remitting any sales taxes, since other market facilitators already do it.  When i asked the question.I just wasn't sure what would happen if i all of a sudden start reporting 15,000 in sales, with "0" in state sales. Ill give them a call Monday though to get it clarified. My accountant died, so it's been a PITA to get his family to give me any information, I've been emailing them every week, and their communication has been bad, still waiting for my 2020 corporate and personal tax copies to  show in the mail  ><    sigh

If you find out let me know as I'm in the same situation.  Now I file the monthly sales as tax free since if I don't I would have pay sales tax on them.

Yup, I'm in this boat, too. I've been collecting and remitting Florida sales tax for years (which can be a pain on eBay due to the 'destination-based' Florida model), and I noticed when Florida started being included within the 'Managed Tax'. I still haven't looked at the paperwork to see how to do it from now on.

 

Nonetheless, I suspect that it will be along the lines of XXX.XX$ in gross sales, YY.YY$ in collected sales tax and YY.YY$ as a lawful deduction, 0.00$ to remit. Considering how this is going to be a mess for tens if not hundreds of thousands of sellers, I expect a lot of errors and a slow onboarding process. The department is probably as swamped as we are, so I doubt they'll go full-autistic on our returns for a while.

 

My areas of concern are:

- If it is worth the hassle of having a sales tax certificate just to file a 0.00$ sales tax return every month/quarter? It may be, due to the resale certificate, or because you are selling on other platforms (though those likely also remit tax on your behalf), but it is something worth considering.

- If one is due a deduction which would normally be deduced from remitted sales tax (like improperly billed sales tax on items purchased for resale), but sales tax return will be 0.00$ from here on out, how does one get back what one is owed?

 

On the bright side, at least Florida finally discontinued that nightmarish 'Bracket System' for sub-dollar amounts. Plus, 'Use Tax' is going to be one less thing to worry about. As long as Florida doesn't implement an Income Tax, I think this is overall bearable as long as the kinks are ironed out.

Were you able to call the FL DOR? If so, I'd love to hear how they said to proceed.

 

I'm in the same boat - seller in FL, ebay is the only source of income, ebay is remitting all sales tax now. I'm curious how the DOR wants us to handle this. Whether we continue filing returns just for "use tax" or something else?
