It is with much sadness and great sorrow that I have to inform you after 15 years of being a seller I am forced to close down my store because I was treated unfairly by eBay. eBay chose to side with a less than one year member against me. The buyer bought an item from me damaged it and used the damage against me to get a refund through eBay and even though I presented picture evidence that the item I sold was perfect, still new with only a few hours usage, it was not good enough, I was told by an eBay agent that my pictures didn't count, but they accepted the buyers pictures accusing me and that there was nothing I could do that eBay had already made their decision in the favor of the buyer and that they had already refunded to the buyer and that my paypal was charged back with the amount and that I needed to add funds to cover the debit to my paypal plus I was still charged a final value fee although I made nothing from the sale and was returned a damaged item that can not be sold.
I have an item valued at over $3,000 sold for $1,750 that is of no good to me and I have picture proof that the item was in excellent condition and had no flaws when it was sold and now I have a worthless item and I have no choice but to shut down my store because of a dishonest buyer that eBay decided in his favor against me a member in good standing since september 24, 2003. Now I have nothing after over 15 years of hard work because of eBay's decision based on the buyer protection plan they have to agree with the buyer I was informed so I stated so seller's have no rights I was told I could appeal then after they instructed the buyer to return the item to me they informed me I was not allowed to appeal because their decision had already been determined. No one took the time to believe me or to even look at the pictures that proved the buyer was flat out lying and believe you me I telephone numerous times and replied to each and every message from the buyer, presented messages from the buyer and pictures to compare that the item was damaged by the buyer not me. First the buyer said that he was unaware that the item was used which I told him was not true because I explained to him in a message that the item was turned on to view by the previous owner but not actually used but because a concentrator is determined it's usage by hours that it had to be listed refurbished ( as instructed by an eBay representaive) but still new which I did, he replied with a offer for $1750 which was $200 less than the listed selling price and buyer stated I am making this my final offer since you have told me that it is used. So yes he new that was his first lie. Then he claimed that the item had missing screws and when I told him to zoom in on the pictures in the listing and he would see that the screws were not missing lied again then he stated it was damaged his thrid complaint not the first but the third to request a refund. My determination to eBay was if I myself received aitem that looked like this piece of trash that he returned to me then I would asked for a refund based on that it is damaged and is of no good not that it was used then it had missing screws and then finally after me refusing his request and showing proof to substantiate by reply he states it is damaged why not say that in the beginning I would have and anyone telling the truth would have. Because pictures don't lie so he had to make up a story to try and get what he wanted. I do not believe that the machine he returned to me is even the same machine because it had scratches on the fron that was not there when I packaged it to ship, since this is a medical type item I have a registered nurse that checked out the machine prior to selling to witness that the machine was working properly and was in perfect condition. The machine I have now is literally falling apart at the seams and can not even be plugged up or removed from the cart that is it setting on because of the damage it has sustained. eBay did me wrong, I was treated unfair to say the lest eBay never even took the time to hear me and make a decision on the facts but instead agreed to give the buyer a refund on a item that he damaged looks like the side was pulled apart. Not by accident not a mistake but purposely done. I have been seliing far to long to think that I couldsell and ship a damaged item to a buyer and not have to refund back to them. Sellers don't count anymore, a seller can only leave positive feedback for a buyer but a buyer can do anything they please and get by with it, they can leave ugly degrading feedback and eBay turns a deaf ear, and as I told eBay rep number 7 I talked with as my final attempt without sellers eBay would not have buyers but we are nobodies just a hard working nobody with a ruined 15 years of establishing a business and now it is all gone with one click of a computer key from eBay. I refuse to be forced to give money to a dishonest scam and also pay a final value fee on an item that the buyer damaged and returned and requested a refund. Please everyone with an opinion give me your honest thoughts on this I would appreciate any and all advise I have been falsely accused and it is just wrong.

Sorry this happened to you. Looks like the buyer got to replace their garbage with your item.
Just to note. eBay is not here. You are yelling at other eBay community buyers/sellers.

Yes I know I am just so aggravated that they can not see what a scammer he is and that is intentions I do believe is exactly what he accomplished to scam someone and make some money in the process he may be replacing an old damaged machine that he had for my new machine or worse yet maybe he pawned an old useful machine off on me and got a refund for it and is going to sell the nice new machine I sold to him but either way he won and i lost and I was hoping that some way some how someone anyone associated with Ebay could get the message back to they complaint compartment I have never had to do this because I have never been treated so wrong I have been hacked at my bank I have had people to write fraudulent checks on my bank account but my bank looked at the evide3nce and stood by me and fixed it and got the dishonest person but Ebay did not I lost and he gained thank you for your time and input

Was it damaged in shipment?
Did the buyer provide any photos of the item when they received it documenting the alleged damage? Did they provide photos of any damaged packaging?
Did you record the serial number of the original unit or place any type of warranty seal on the device when you sold it?
If you honestly feel that you received a different unit in return and the buyer is scamming you, for the amount of money involved, I would take the buyer to court. They may have no problem lying to eBay but you can see how they fare before a judge.
If you can prove that the item is not the one you received, I would file criminal with IC3 and probably State Police in the state of the buyer's residence, in addition to a civil suit. In most jurisdictions, over $1000 is going to be a Felony.

I understand this is an extremely trying experience for you, but it's important to try to get a better idea of what truly is happening.
For starters, the damage I see in the pictures looks like the two halves of the case pulled away after the screws let loose. Is there more damage than that? And, as has already been suggested, is there any chance that this was damaged in shipping? One could certainly visualize the damage pictured as a result of being dropped with some, but not enough, protection.
As for eBay, unfortunately pictures do not prove anything. I could send eBay half a million pictures of the Mona Lisa, but still send or return Dogs Playing Poker. eBay sides with the buyer not because of her pictures, but because eBay feels it's in eBay's best interests to give the buyer the benefit of the doubt.
If it is possible to determne that the buyer switched items on you, then you should certainly file complaints with Postal Inspectors and maybe even your police department.

Ebay does not accept pictures of what the item looked like when you shipped it..damage can easily happen in shipping.

Sorry to hear that your item was stolen.
Sell the expensive items that you cannot afford to lose locally and for cash payment. Sell the less expensive items on eBay and take your chances on a loss that can be afforded.

They never did and never will as long as we are held responsible by the credit card companies for any buyers scam.. It's not ebay, it's not paypal, credit card companies need to look at fraud beyond item not delivered. but then again why should they?

I ordered a battery charger with similar construction and it arrived in similar shape, but the box looked ok.
Check the machine and see if it's the same one, if it's not then come back for more advice
