Items termed fraud

Recently I had 11 auctions ended by Ebay saying I was listing fraudulent items.  These are some building block items I bought on Ebay from China.  I did not list under the popular brand name from here in the States.  The only time that name was brought up was under compatible and Ebay gave that option.  Can anyone tell me why my items were cancelled?  I bought them on Ebay and would like to now sell them on Ebay.  I don't want to cause trouble.  I've been a member for about 20 years.  I can't find a place where I can actually ask what was wrong.  Any ideas?  Thanks!!!

Altho your items are “compatible with” Legos, it is the fact that they infringe on the Lego brand design that make them unacceptable. Legos brand aggressively polices the platform looking for the counterfeits. Sometimes the offending items slip thru the cracks and don’t get removed. It makes for a good deal of confusion. Afraid eBay isn't known for its consistent application of its policies.

 

Below is the policy covering the use of terms like “compatible with” for anyone interested.

You can't sell those fake LEGOs, no matter what you cal them.

Surprised the other listing wasn't removed.

Pretty much any replacement part or generic version of anything sold by Chinese sellers are unauthorized. That you bought it on eBay does not mean you can sell it on eBay. Why are the Chinese sellers allowed to sell it? eBay's site, eBay's rules.  Just don't relist it or you could get suspended.

Thank you for the fast response.  What is strange to me is that they let 2 stay listed and one actually sold.  Was this just a mistake on their part?  I keep thinking there is a way to list.  You just have to be specific and careful.

Usually its eBay bots that hunt for these listing or someone who has trademark the item (such as Lego).

Not all items get tagged by eBay, not all items get found by trademark hunters. Even if they do remove them there are 100s more sellers within a month that will list the same item because you know, eBay can't control all the new accounts that are created by Chinese sellers of if they list same items under different titles.

I think there is a way to list that is acceptable.

 

Not acceptable, just not the unacceptable wording that the bots have been programmed to look for.

Counterfeit is counterfeit.

And Lego may not be Disney, but they are very protective of their brand.

 

If something is sold, paid and shipped, there's not much eBay can do. But don't try to relist  fake Lego here, and probably you should take down the others before they are spotted.

 

There are other, less law-abiding places to sell counterfeit goods.

Counterfeits are not allowed. Never buy from China.

LEGO won a lawsuit against the company that makes those blocks. The court ruled those blocks violated 18 LEGO trademarks and copyrights. 

 

It does not not matter how you list an infringing item - it will still be an infringing item.

Probably because LEGO's ability to locate and report infringing items is not perfect.

You are wrong, and could end up losing your ability to sell if you continue to list items that infringe LEGO's intellectual property.

Buying items from China is a risk in itself, as they are the capital of fraudulent merchandise.  Please do not attempt to re list them.  It could jeopardize your account.  Good luck.

Probably many slip through the cracks because eBay's search feature is so terrible that the Lego company can't even find them.

Thank you all for the information.  Guess I will have a lot of "Building Block Sets" at my next garage sale.

If you folks don't know a way around it, I'm guessing there isn't one.  Have a wonderful day!!!
