Basically I'm selling a phone and a buyer wants to trade his phone for mine. He has a listing up if we both purchase it and dont pay but mark both items as paid is that fine per eBay policy? Because eBay would still get there fees. And we still have buyer protection. Thoughts?

No, that's no OK and something like that could get both of you banned.

If he wants your phone he should buy it and pay for it.
If you want his phone you should buy it and pay for it.
Remember in addition to the proof of delivery, you need some proof of payment.
I'd add him to my Blocked Bidder List to be honest.

Not allowed but I gotta ask. Are his feedback and history good? You both agree mark paid you ship, end of story.

- Trades – listings that tell buyers you'll accept a trade or a partial trade as payment.

Only sellers on eBay's Italy site can do trades like that. Not US sellers.

That only applies to the listings where you specifically say you will barter - not a question from a buyer to trade.
