I understand the possibility and ebay allowing a buyer filing a return request after losing an INR... because the item can pop up to the buyer afterwards and they are unhappy with the item.
But what about the other way around? Would ebay allow a buyer to do that? File an INR after losing out on a return by not returning the item within the time window?

Well, logic dictates that an INR would not be allowed, since they received the item. So you're probably somehow screwed. 😂

They might be able to file an INR the question is can they WIN an INR after filing a return.
If you have tracking, proving delivery the answer should be no..
But as this is the "new" eBay- the jury is still out on this at times..

I agree. The problem is (and I probably should have stated this in my OP), a buyer messaged me asking to return for a remorse reason. I instructed them to file one on ebay. By default, the shipping price is non-refundable to buyers on remorse returns.I had actually noticed that the original tracking on this item isn't complete (carrier messed up and didn't scan it as delivered).
So had the buyer returned the item in time, I would refund the buyer less shipping and the return would close. But the buyer didn't return the item. So it closed in my favor. That made me wonder if the buyer successfully files an INR, they'd win (with a full refund vs the remorse return with shipping retained).

I've learned to not wonder. (But in this case, I don't see that the buyer would be successful.) Enjoy today!

Ok did they return the item? It just doesn't show as delivered?
If yes, I would refund minus the shipping.
If they did not return and let it time out, it's highly unlikely they could win an INR if you upload the original tracking.

I think you are misunderstanding about the tracking. The buyer never returned the item (to my knowledge, no tracking uploaded on their part and the return already closed because of that). The original tracking was the one that doesn't show delivery, so if I upload it in the event of an INR... I'd lose.

Yep, you were correct, I did misunderstand about the tracking..
You could try calling the PO and asking them if they can update the tracking for you. I've seen some success with this.
Hopefully if they file the INR, you can use the original return request in your case but..
The first case may close in the buyer's favor- APPEAL, that will get actual human eyes on it- upload the messages about the first return, hold your breath and pray.

It is my understanding that under the MBG, a buyer can file ONE and ONLY ONE case *on* eBay. If they lose one, they do not get a second bite using a different reason.
However, if they paid with Paypal or a Credit Card, they can move on to them and file a case there.
