Listed the used iPhone xs max for sell because I bought the new IPhone 13.  I'm thinking I can make a little more money but it turned out I lost everything.  The buyer scams me.  I sent the buyer my used phone.  It fully charged.  The buyer message me and requested the return, the buyer said the phone is  not turn on, but I just used it and I know my battery is still at 85%.  I've been using for almost 3 years and it's  still excellent condition.  Anyway, Ebay recommended to accept the return so I did.  The buyer sent the FAKE iPhone back.  **bleep** **bleep** Ebay.  Your return policy is pathetic and make very easy to scam.  If I read these comments on this community.  I will never sell on eBay.  I  learned the hard way.

 Sorry to say. Not sure if this might work, but you could report phone stolen and block the IMe #. When it comes to phones, I personally prefer to sell locally, where buyer can verify phone with local carrier, and I get cash on hand.

     Hopefully you had or wrote down the IMEI number before you shipped it. If you did you can report it to the following site as stolen and it will render the phone basically useless to the buyer.

IPhones are one of the high priority targets for scammers. EBay is NOT the best place to sell an iPhone or a lot of other types of electronics.

Assuming you have the phones information such as IMEI, I would present this to eBay because the case is not over. The customer complained it wouldn’t turn on, which says, you sent the phone over but clearly you got crap back. Don’t consider this a loss. eBay can and will side with sellers if you have the proper and valid evidence.

Smartphones are a high fraud item. I would never recommend selling one here. But so sorry this happened to you.

 

There are a couple of things you can consider doing, depending on your comfort level.  The goal for the first is to apply a little outside pressure to get your phone or money back. It won’t involve eBay, and won’t work if you have already chastised the buyer in writing.

I would send a registered letter to the buyer advising them that they have made an error,  that the correct item was not returned. Tell them you are certain it was an oversight on their part because if you thought it to be deliberate fraud, you would have no choice but to go to the authorities to report a theft.

 


 Do not directly accuse them of anything beyond a careless mistake. Do not get angry. Tell them if the phone or funds are returned to you within 15 days, you will drop the matter. Then you wait and see. Scammers do not want to be on anyone’s radar and this might be enough to get your phone or money back.

 

Another suggestion for action you can take would be to bypass the buyer and go straight to the authorities. The purpose is to get this scammer’s name and address on their radar. This won’t get your money back. But I would contact the police in both your and their jurisdiction. Then make a report to the Postal Inspectors as the buyer used the mail to defraud you. (They take that kind of crime seriously. It is a federal offense). Last, go to ic3.gov to make a report to the FBI’s Internet Crime Complaint Center. Get case numbers for all the reports you make.

 

Finally, you could file a lawsuit in small claims court. The case notes from the authorities could be submitted.

appeal the case as a seller, you have 30 days.

take a picture of the fake iphone inside of the box, and the label on the front of the box he sent you that has his address on it. this is a classic buyer scam. you need to appeal ebays decision and you have 30 days to do so, but i dont like to have my money hanging in the balance like that so i just do it immediately if this happens. you have to have proof, so the pictures of the item you received back, and the item you sold have to be labeled as such, and added to the appeal. if ebay refuses your appeal which isnt likely, especially if its obviously not the same phone, you can then go to paypal if you used them, and explain the issue to CS. report them on both platforms rtc. if you didnt use paypal, go to your car issuer and provide the proof and make a claim for fraud where the money was transacted.

How to appeal a decision

To start an appeal, follow these steps:

  1. Go to your Seller Dashboard.
  2. Expand Closed without seller resolution to see your options.
  3. Select See cases and find the item in the list.
  4. Select See details and then send us an appeal.
