I need help please

I tell you my story a month ago I sold a Sonos in wall speaker and I sent the product on January 30 and the buyer received it on February 4, the buyer did not respond to messages and until 2 weeks later. I had to leave the complaint because the money was not released, the buyer insisted that he did not receive it, after proving to eBay that he did receive it, eBay released my fund, now 1 month after the sale, the buyer wants a refund because it is not the correct product!! you're crazy? First you want to steal it and then you say it's not the right one? 1 month later? How does eBay support this type of scammers?  What I can do ?

I took the product out of the house to take photos of it and thus show that it is fully tested and tested, I believe that eBay is not safe for everyone, you cannot play with people's money

That topic is moot.

Your buyer opened a return. Accept the return, send the return label, get your item back and refund. Case closed.

You seem to not want to accept what everyone is telling you. You are fighting a losing battle, eBay will side with the buyer. 

Accept it and move on...

By the way I'm not your brother.

This is true, both from the buyer's and seller's perspective.  Not all buyers are honest and not all sellers are honest.    In your case, you feel the buyer is dishonest, but I would take a wild guess that he may think the same about you.   Whichever, with eBay's policies, the buyer has the upper hand in a dispute.

 

If you feel eBay is not a safe place for you and if you meant it when you said you will never sell on here again, that is your right.  If you decide to continue selling on eBay, it might be beneficial to you to familiarize yourself with eBay's rules and policies.  Whatever you do decide, best wishes to you.

my WORD.  Everyone is telling you how it works and you need to accept the return, when it arrives back then refund.  Do it your way and you will be here griping that you lost your item AND the money.  Go ahead and do it your way.  No skin off our noses.  YOU WILL BE THE ONE AND ONLY ONE THAT LOSES!!

You are absolutely right:  eBay is not safe for everyone.  But do you understand why? It's because both buyers and sellers launch themselves here without first reading all the information about how eBay works.  For instance, eBay offers the Money Back Guarantee for buyers.  If a seller does not make it his business to learn what that means, sooner or later he will run across a problem.  If he decides to handle it his way instead of the MBG way, he's guaranteed to lose.

Think about it.

Every eBay transaction carries the risk of fraud, because a buyer can file a fraudulent dispute. 

 

eBay allows this because if a package arrives late, a buyer still has the right to a refund if it is not as described. 

 

Let's pretend that the buyer really didn't get his item, despite you having tracking that suggests he did. What recourse would a buyer have if he loses the item not received dispute?

 

The reality is that the buyer might decide "Fine - if eBay says I got a delivery of nothing, then I am going to claim that nothing is not what I ordered".

What can you do? - In this case? - Nothing

What can you do in most INAD Cases?  - Nothing

 

(Actually you can pull all the stops out and file reports with every fraud and theft agency and department in the book - Its a time consuming slog, but you can use that information to file an appeal - If that doesnt work, use social media to report exactly what happened to you)

 

The site will tell you its "a cost of doing business here" - But it seems they dont consider it a cost of doing business for them - Oh it is in the long term, because they lose customer confidence and business - But in my opinion, the site doesnt do ANYTHING with the "long term" in mind - They are beholden to reporting numbers every three months - and they operate as such - So its the seller that takes the hit from one of the sites unvetted, fraudulent buyers(who from our experience operate as such regardless of how many times they are reported) - The site gets to show another sale for the next 3 months financial reporting and the seller gets a loss and a slap across the face - funny how that works - no wonder they do so little about it...

It's possible he opened not received when he should have opened not as described, doesn't  match, wrong item etc. When some people receive the wrong item they automatically chose not received because in their mind they haven't  received the item they ordered. Then they usually come here complaining eBay closed their case and we tell them they opened the wrong type of case because they did receive something, it's just not as described. Then they go on and open a return case like they should have done when it doesn't match.

 

I think something like that happened.

You'll need to refund or send them a return label.

Why would you keep asking the buyer if they got it?

 

Why is the buyer a thief if he purchased something, paid for it and received it?

 

Now he wants to return it? How is that thievery?

Let me explain it to you in better ways to see if you take it, if you buy something and after 2 weeks you say that you did not receive it. the item, but I have photos of the package at your address (photos supplied by UPS), with the address supplied by yourself, what you are trying to do is delay my payment and try to keep the package and the money back, well now I talk to eBay and show eBay that you do have the package. Well, a week later you want a refund because it is not the correct product! (You had 28 days with the package, why not tell him a few days later) why first you tried to lie about receiving it) is this normal for you? Well, if it is normal for you, eBay has the reputation it has, it is because of these types of people.

You've received a lot of accurate and helpful advice (from most who responded) and I won't pile on that. 

 

I do not argue that there are plenty of problem, difficult, high maintenance and dishonest buyers. But what's done is done and you and he found each other. 

 

But I do have other suggestions should you get the item back. 

  • Once you've shipped the item and tracking starts to show movement and delivery, NEVER, ever bug a buyer to confirm. Rest assured, you WILL hear from a buyer if there's a problem, whether it's non-receipt or not as described. There's never a need to poke the sleeping bear.
  • As a seller, you can only leave positive feedback with positive comments for buyers. If your buyer reports the feedback, your own account can get dinged for misuse of feedback
  • Your listing shows and charges for USPS ground advantage. You cannot change the shipping method to UPS since it's not what was advertised.

 

If indeed the buyer lied about the item being not as described, you can report the buyer but you must accept the return and issue the refund first without ebay having to resolve the case

Abusive buying activity

When we determine that a buyer has violated the abusive buyer policy, we will remove any associated negative or neutral feedback and defects, including any open cases in service metrics. For abusive buyers, we may also limit their ability to request returns on eBay. In serious cases or repeated abusive behavior, we may suspend the buyer's account.

You can assist us by reporting the buyer - opens in new window or tab and clearly describing what they are doing. This will help us investigate potential policy violations and take actions to protect you.

An item is returned after it was used or damaged by the buyer

Sellers who are not Below Standard are eligible for this protection for listings that offer free returns.

If you accepted a buyer's return request but the item is returned in a different condition than it was originally sent:

  • You can deduct up to 50% from the refund to recover the lost value of the item
    • We'll automatically remove any related negative or neutral feedback
    • If the buyer had requested the return because the item didn't match the listing, we won't count the return in your "Item not as described" rate in service metrics

It would appear that your buyer opened an Item Not Received claim, but you won that claim as you could prove delivery. Later, your buyer opened a Return request, which is a different animal entirely. >> eBay Money Back Guarantee policy
