We sell about 2000 items a month. Last month I got restricted 3 times back to back total of 27 days with loss of sale around $100k.
Even we asked ebay before listing on of the items and they said we can list which was "Nellcor Adapter Extension Cable" . Even we check anything suspicious to list on FDA site and comes as non-prescription. This item has been selling on eBay for a long time and some sellers have sold 100s of them. Other items was Applied BioSystems 7900HT which sells on eBay and it is a LAB equipment and eBay removed and restricted for 10 days and their reason was it needs prescription. I have called FDA and other bunch of places and non said it needs a special permit or prescription.
After that we have removed everything off eBay anything which is related to Lab or medical. We missed to remove a Nasal Cannula which you can buy it any where and I got restricted for 10 days again right after 10 days restriction.
eBay costumer service told me yes you are correct and we will restore your account, but they did not. When I pointed the other listings they just brushed me off.
I believe my account has been discriminated because there are no other expiations. Also my account has been with low returns and 100% feedback for 18 years. Now if I got another restriction, My account will be suspended forever.

Call Pittsburgh corporate HQ and ask for the V.P. covering customer service. Keep calling until you finally get to speak with him or her. You might even google up the current list of officers of ebay first, so you can ask for them by name.
I did this once to get a fraudster I'd been complaining to C.S. about for several months off, and the guy was very nice and removed the offending account that same day I spoke to him.

Did you contact eBay CS and talk to them on the phone? If you did, those CS reps cannot be trusted to give you accurate information. Quite often they will read from a script or tell you anything just to get you off the phone. They are outsourced contract people, often not US-based, and not real eBay employees...
Or did you contact a real eBay employee on eBay for Business on Facebook (using the Send Message button)? or on Twitter? That's where 9 times out of 10 (so to speak) you will get a problem solved or be given real information you can trust.

@techmalloutlet I am not sure why eBay would "discriminate" against your account.
Usually what happens is if 1 item is pulled it puts your account on the BOTs radar.
It doesnt matter who or how many others are selling the same thing. Just like it doesnt matter if everyone runs the stop sign but you got pulled over and received a ticket.
eBay CS is mostly there to tell you what you want to hear and then go on to the next person.
Best to be very careful as to what you list. Dont go by what CS says OR what others are doing.

Ok, it looks like you are getting strafed by the Medical Devices policy?
It sounds as if you have already decided on best protecting your interests by not listing any medical device accessories. That’s what i would recommend now, especially not listing anything related to the CPAP sleep apnea devices, like the Nellcor adapter.
Your experience in these regards has been an ongoing problem for eBay sellers. There has been a lot of confusion over what is, and is not, allowed. There are complaints from sellers going back several years ago, some getting their listings incorrectly pulled and then accounts unfairly suspended. (Apparently buying the accessories often does not require a prescription, even if the device they fit does require one.)
