How long do buyers have to open a case?

Recently sold a vintage pin (kind you might have bought at a concert or store with the celebrity you were into on it).  We had three listed at once in one buy it now (you will receive one of the three).  No one bought any after a few months.  So we set them up to sell one at a time.  Sold one.  Buyer receives it; says it isn't the same pin as in the picture.  I explained it was possible we sent the wrong one (all have the same wear but still our bad).  We have offered to exchange it, sent him two pictures of the ones we still have and offered a full refund if he just wants to return it at our cost.  He wants a partial refund and just keep the one he has.  To us, sounds like buyer remorse.  When we did send him the two pictures to choose from it was the next day before we heard from him (proably because that's how similiar the condition is).  He's "**bleep**" that we won't send him a partial refund (he wants it for the opening bid price pretty much).  He threatened our feedback without saying "feedback".  He also said he has 60 days to file a case.  I have tried to find this on ebay to see if it's true.   Can anyone offer some advice?

He's probably hoping you'll just refund and let him keep the item.

Just keep telling him to return for a refund.

I think they have 60 days to leave feedback.

They have 30 days on Ebay to open a case and 180 days on Pay Pal.

Thank you for the reply.  I also saw that we can ask eBay to intervene and make the decision after three days of not reaching a resolution.

Has the buyer started an INAD case?

If they have started a case, approve the return and send a return shipping label.

If they haven't opened a case, wait until they do.

If there is a case open and you don't take care of it yourself and Ebay has to step in, you could loose your money and item and get a serious defect for not handling the problem.

This.  Frankly I'm against partial refunds under any circumstances.  Particularly when they are suggested by the buyer first.  Once they start with a laundry list of reasons why a return is out of the question (like "I don't wanna deal with the hassle") is when I'm pretty sure I've got a scammer.  Especially when they go right to the feedback card.

If you are unhappy with a purchase, you have to return it in order to get your money back.  Period.  No where else is a partial even an option much less so commonplace.  Try demanding one on another site or a B&M and let me know how you make out.  The OP offered two perfectly acceptable resolutions to the problem.  Now it's up to the buyer to either accept one of them or not.

Thank you Joe... That's how we feel.  You can't go to Walmart and get a partial refund or wait to pay for an item whenever you feel like it (this buyer was hours away from me opening an unpaid item case).   He started to get nasty when we said we don't give partial refunds.  Since this started yesterday that is now in my "fine print" at the bottom of my auctions.  He claims the pin is faded but honestly none of them were.  Plus if he says it's so different from the other he has yet to offer a picture of what he received.  If I was on his end trying to show that there is a differnce I would have sent a picture.  But we have offered him the two resolutions which neither was unreasonable and  by doing so we accepted responsiblity for the error.  He said we have shown "no remorse"...

Buyers now days think they can ask for a partial refund instead of returning an item.

If they want to keep the item bad enough, they don't need a partial refund.

If they want their money back, they need to return the item.

When they come up with a bunch of excuses for not wanting to return an item, then they aint getting any money back.

Dear Buyer,
We are truly sorry you do not like our solutions, however we are unable to Grant a partial refund at this time. Please open a formal return request and I will send you a prepaid label to ship the item in question back.

Just keep repeating that to them

Return for refund and nothing more.       You aren't sure if you made a mistake or not. I do not believe in partials. Good enough to keep? Good enough to pay for. This isn't some 50lb. item that has to be dragged to the P.O.    If you get negative feedback just state offered a full refund upon return. When other sellers notice that a buyer was offered a refund and still left a negative they may block him. You can't leave a buyer negative but this works almost as well. Way too many buyers asking for partials.

I understand as you said that before.  Is there any reason why you prefer to not give the buyer the partial refund that he has requested?  Just wondering as that would cost you less.

I agree it is not appropriate for the buyer to ask for that, and that it is up to the seller to offer solutions.  The buyer should choose from those solutions.  But the if it's good enough to keep, it's good enough to pay for does not take into account the fact that the buyer did not get what he bought as you yourself said you might have made a mistake.  I commend you for offering resolutions, but is it a resolution if you are hoping the buyer won't return.

CS will say anything that they think you want to hear.

You must resolve in the time given.

Turning it over to eBay to decide is iffy at best, and is likely to fall in the buyer favor. They may get a refund, and keep the item.

A partial will then look like it would have been a good decision, just too late.

A buyer has 60 days to leave Feedback. I wonder if that could be what he is referring to?

I think you are right!

You aren't supposed to list items like that just letting you know for future reference it's against the rules and falls under fee avoidance.

Buyer has thirty days to open a case on Ebay, and 180 days to open one on Paypal.

Buyer also has their credit card company to go back to.

Just an update....  Good triumped over Evil!!!

Seller left negative feedback this morning.  Saying we sent a different item and didn't admit to our mistake.  Called ebay; even they said by offering an exhange or refund we admitted our mistake and he had no reason to leave negative feedback.  They removed his feedback within minutes!

All because we wouldn't give him $7 back.  Now both our remaining pins will go out for auction tonight... Marked "lot A" and "lot B".   The mixup was our mistake and we tried to rectifiy it.
