eBay had my 400$, seller and ebay did not issue me a refund and they said item was delivered.
but it was refused by me and i was told i will get refund by the seller and by ebay.
and it was eBay money Guaarante but they don't wanna issue me a refund.
so, i have all the proofs, is there anyway that i can file a police report for this??

Just curious why you refused the item? Pretty sure you can go to your local police station and file a report. Will probably have better luck at the state police. Best regards

If you refused the package, you gave up your ebay MBG. You should read that.

The seller cannot refund you until he gets his item back.
Returning/refused mail is USPS Low Priority, which means it can take anywhere from 2 to 5 weeks for the seller to get the item back.
You can't expect a refund until the seller has the item. How long ago did you refuse it (and why did you refuse it??)?

Sure you can file a police report but why waste your time and theirs? You refused the package, which makes you ineligible for the money back guarantee. The police will not actually do anything other than write a report and file it away. They won't investigate ebay or the seller.

You have to wait at least 4 or 5 weeks before even considering filing a police report.
The seller is obligated to refund you if the item is returned in original condition, but as I mentioned, this can take several weeks, so if it has only been a few days or a couple of weeks, it would be a ridiculous waste of precious police resources to file a report on a seller who hasn't done anything wrong.
YOU are the one who changed your mind, so you will have to be patient.
In the future, if you change your mind, ask to cancel the order if it has not been shipped. If it has been shipped, consider putting fresh postage on the package so it gets to the seller faster if you want a quick refund.

THanks for the answers, I was asked eBay on the phone that If I refuse those shipments, will i get my money back? Because If i don't refuse them, seller can say, there is something missing in this package and it will get me into a trouble.
eBay said, yes you refuse the package and you will get your money back. I am also going to my local police department now

why in the world would you go to the police station this is a civil matter.
File a small claims case against Ebay, it's simple, and costs like $40 bucks.

I am sorry to say that this is not a Police matter - if the item was marked as "Delivered" but you stated you refused it, it cannot be both "Delivered" and "Refused." As a former eBay Seller, I would not refund either if I see that the tracking is showing "Delivered," and nothing stating it was refused by the recipient. The first thing that would come to mind for me would be that I am being scammed one way or another.
The only way to file a Police Report would be if the package is shown as "Delivered" and perhaps if it was stolen from your home. Even under those circumstances, neither eBay/Pay Pal/Seller is under no real obligation to refund if delivered.
It is ethical for the Seller to refund you since he cannot keep the item and the money, and I hope he/she does, but refusing pkgs voids the MBG. And it is Pay Pal/Seller that has the funds, not eBay.

Why did you call in the first place? You should have read the money back guarantee instead. You can’t just change your mind and refuse a package here. You have to accept delivery, request a return and send the item back at your expense.
