There's a seller (who I won't name specifically) who, in their item description, uses the exact phrase "This is a PRESALE that ships within 30 days. Only purchase if you plan to wait as no order cancellations are permitted - commit to buy." (you can google this WITH quotation marks to see for yourself)
He uses this phrase to presell items that won't release until 3 or more months later while avoid getting moderated by low-level eBay employees that don't know any better. No amount of "report item" does anything.
For example, he's been selling stuff like Tales of Arise which won't release until September (a whopping FIVE MONTHS AWAY), for example, and you can find the exact same wording above. Other examples include the Beastars Vinyl Soundtrack which has a release of July 26 (87 days away as of this post) and Megalo Box Vinyl Soundtrack which releases in July (3 months away). These release dates are all easily found with a simple internet search.
This is grossly unfair to the rest of us who follow the 30 day presale rule as they are profiting with no competition.

@therapy_dragonhere you go. This article has a link below that will allow you to report a listing that violates eBay's policy. Moderators only manage the forms, and I appreciate your enthusiasm for reporting this buyer, but reporting it will let the admins know.

Also, don't share any personal info about the seller here on the forms because that causes posts to get removed by the mods. I have seen it happen

Reporting items doesn't do anything as the employees who check on them can't be bothered to do a simple google search or see if the seller has even shipped any of the listing's many months-old sales.

@therapy_dragon there was a seller violating the pre-sale policy that eBay was actually promoting on their official Twitter page. It was reported multiple times by multiple people to eBay staff on Twitter, through the "report listing" link, and I also brought it up in a weekly chat here - yet it was allowed to continue and had almost 250 sales by the time the listing ended. 🙄
Unfortunately, reporting the situation to eBay doesn't seem to do much - but I do advise buyers who are affected by it to report the practice to the FTC if there are possible 30 Day Mail Order rule violations in play.

I respectfully admire your persistence (I really do), but you're most likely not going to get a resolution here. You've done all you can do, it might be better to just let the thing run its course. There's sure to be some outraged buyers on down the road when that seller doesn't deliver as promised and eBay listens when buyers complain.
Naughty sellers eventually get their due - sometimes it's better to just sit back and let it all play out.

It may take more than a single uncorroborated report to get eBay to act, unless the policy violation is blatant and severe. But it is a good start; if others also make reports, that is likely to get eBay's attention.

My curiosity made me Google the phrase the OP stated and I'm actually surprised to see that this seller's listings appear on ebay.au and ebay.uk and ebay.it and ebay.ca......just wow.

Yes, there is a way to report this violation. Each listing has a Report This Item button. Click on it and then follow the prompts. To specifically name the Presale violation, use these heading as they appear:
1) Report Category—pick “Listing Practices.”
2) Reason for Report—choose “Inappropriate Seller Terms.”
3) Detailed Reason—select “Presale”.
Then click Submit Report. Another page may appear with room for more info.
One thing to keep in mind is that eBay does not share whatever action they may take as a result of such reports, but i have seen listings come down. Ebay gives more credence to buyers who have had a transaction with the reported seller.
PS- When using a computer to view listings, the Report This Item link can be found on the right side of the page just above the Description field, in tiny letters. When using the app on your mobile phone or tablet, the button is near the bottom of the listing in a box. Good luck to you in your endeavor.

This report does nothing because it states it only applies when "The listing is for an item that's not yet available to the public, and it doesn't clearly state it's a presale item."
The minimum wage foreign employees hired for the menial labor of checking these reports are likely held to this strict criteria. He technically is stating it is a presale item. So even if the release date of something like the Evangelion Last Kiss vinyl he is selling has a release date of OCTOBER, that ridiculous phrase is apparently enough to shield him.
