It's already been said, but eBay are not in a $1.9 Billon predicament. That would be us sellers. Except for the fact that as that $1.9B snowball rolls downhill toward us, it will get bigger.

The lawsuit extends the control of the government over ecommerce.

 

Recent attempts to do so by the FTC, DOJ and SEC have been rebuffed by the courts.

 

We'll have to wait to see how this suit and the recent FTC vs Amazon suit come out. While we wait we can hope that our fees are not raised to pay for the added legal costs, and Ebay does not purge more listings which have no problems with the law.

 

Of course, we can add references to George Orwell as well as Ayn Rand to forum posts.

And whatever eBay ends up paying in fines (most likely much less than $1.9B to settle it) could be just the tip of the iceberg. At least one shareholder rights law firm is already investigating the possibility of filing a class action on behalf of investors against the eBay Board for breaching fiduciary duty due to this EPA situation as well.

It is in Ebay control on how the fines would be financed. If Ebay loses and increases fees to cover the loss there will be a mass exodus of sellers/buyers from this site. Either way if Ebay does not win it will be the end of Ebay.

If eBay has one employee with a brain and a voice, they would let sales continue as they used to without the need for paying huge percentages. I would rather have no sales than pay eBay 30%-40% for their legal problems. All they need to do is look at their last 12 or 16 quarterly reports.

Just a note of clarification:

 

I did not see a "$1.9 billion lawsuit" from the department of justice.

The $1.9 billion figure appears to come from someone calculating the total if the DOJ imposed the maximum fine on each alleged violation separately. 

 

I suspect there will be an eventual settlement for a number far lower that that.
