Help!! buyer damaged my item after received, now requesting a return and refund

I sold a LV authentic bag to a buyer, (the bag strip was spotted a little since it was rained a few years ago)

I took serious pics in my listing and stated the strip problem, also stated no returnable and refundable item.

this buyer bought the bag and cut and ripped the strips, and took photos claiming arriving damaged! unbelievable.

I called Ebay and tried to ask for opinions and they said ebay will not investigate the case and cannot tell whether the item is damaged when arrived. So if buyer request return ebay will issue return label and return to seller, and paypal will be refund to buyer.

 

Anyone know how should I deal with such a case as a seller?

In your description you stat LV can replace the straps. When you get the bag back about the only thing you can do is get LV to replace the straps and resell it in better condition then it was.

Since Ebay has never seen the bag and don't know how the bag was when your customer got it, they can't say if buyer did any damage to the bag or not.

They will always take the buyers side, even if its wrong.

Sorry this happened to you. This is theft. You need to let buyer know you will be filing a police report in her town (where the crime occured) if any $ is stolen out of your account. Good luck

Thank you for your advice!

I would like to do this but I don't have specific prove that can show that the buyer damaged it.

But I do have listing pictures of my bag, just I don't have proof they damaged it.

sigh...

Actually, from what I gather, you only have your suspicion that the buyer damaged the bag that you claim to have shipped, OP.  Any photos that you took prior to shipping aren't evidence since there is no way to prove that they are of the item that you sent.  I'm afraid that, for this reason, I would deem this to be somewhat poor advice.

Your photos are useless as evidence since there is no way to prove that they are actually of the item that you sent.  Your disclaimers are also useless as eBay's MBG trumps any no return policy you may have if the item arrives not as described.  Basically, it is your word against the buyer's.  

 

If you turned it around from the buyer's point of view, if they made a purchase from you and the item arrived not in the condition it was described as being in when they purchased it, they could easily believe that you are the one committing fraud.  How would eBay know which one of you to believe?  Thus eBay came up with the MBG. 

 

Yes, it doesn't somewhat favor the buyer.  However, in a "he said, she said", situation that is what they decided to do. So your only alternative is to accept the return and pay the return shipping.

If the item was as described -AND- money was stolen out of your account though you provided the service as advertised, then you can file a police report for theft. Ignore that person that said this was bad advice. This is common sense.  It is what I tell my buyers if I feel they are scammers. It also reduces bad feedback from my experience. I've been lucky not to get many but as a Top Rated Seller, they often prey on the newbies is my guess.

Since you advised the OP to file a theft report who would you recommend the OP file the report against ? If the OP gets the bag back was it stolen ?

And this is the caveat to the policy about returns coming back damaged or not in the same condition.

 

"If the returned item is used, damaged, or missing any parts, or is damaged during return shipping because it wasn't packaged correctly, the seller might deduct from the refund to cover the amount of loss."

 

That rule may as well not exists because all eBay has to say is "lol sorry but we were not there to watch the buyer open the package and did not personally watch them package it for return"

I am a little confused here.

 

You say you sent the bag as it was described in the photos you had taken with the strap intact.  The buyer says it arrived damaged.

 

Does the buyer have any pictures that show the package was damaged in shipment?  If something is damaged in shipment the post office has stickers on the package that say it.   I find it hard to believe any damage in shipment would result in just a torn strap.  If the buyer does not have proof that the package was damaged in shipment from the shipper, I would definitely not believe them.  If it was damaged in shipment and the package was insured, can you file a claim against the shipper?

 

This is eBay so you will have to take the return no matter what,  but I would report the buyer for misuse of the return system and put the buyer on your BBL.   Whether you file a police report is up to you but can certainly let the buyer know you might do that.  I gather this was an expensive item so it might be worth a try.

I am confused, you said you stated no returnable and refundable item.

Don't you mean stated no returnable and NOT refundable item.?

 

If so I have bad news, everything sold on ebay is ALWAYS refundable as per the Ebay Money Back Guarantee.

 

Ebay's Money Back Guarantee states 

Get the item you ordered or your money
back—it’s that simple.

 

Fighting the MBG is an exercise that yields no fruit.

 

The problem as well, with a No Returns policy the buyer need not physically return the item to get a refund.

The MBG will override the No Returns policy and force the refund upon escalation (and buyers DO escalate).

As things stand you have two options:

1. Refund the buyer's money and let the buyer keep the item (as per the No Returns policy).

2. Accept the return, issue the buyer a return label, and when you get the item back you refund the buyer.

If item is returned it is unlikely the police will take a report for damage and if they do it is VERY unlikely they will do anything so it gains you nothing
