Hazardous material policy violation question.

I know some listings that are taken down as a violation should never be relisted, but does the hazardous material violation fall into this?   One of my empty bubble light boxes was removed, so I'm wondering if I revamp my titles to merely Christmas light box and leave out the bubble part will I risk another violation since it was removed once?  

The email stated it was an automated removal so the bot obviously didn't have "empty" programed in.

I worry that once anything is removed for a violation your listings are on their radar.   Is it worth it?  It could mean a suspension.
