Earlier this week I found A seller that is using my Ebay name to smear my items. That was Tuesday. 4 time I contacted Ebay and they were promising me up and down that they would remove the listing. They said they take these issues very seriously.
Today I called up again, and they said they that the reason it was not taken down was it did not violate any Ebay Policy, and that there is no proof that this will cause me any issues. This is the Description. Judge for yourself if this would bother you.
Original CCM Maska made jersey. This is not a cheap Asian fake or a knock off that jersey..authentix sells, this is the real deal jersey made back in the mid 90s.
whats really funny is I sold him this jersey. He has purchased four jerseys from me. I had to place him on my no bid list for his rude behavior when I wouldnt agree to his low ball offers. He even tried to use another Ebay Id to buy, but I noticed who is was.
So I guess its open season on your competitors . Get out there and smear their names. Ebay is OK with it

Not saying this to be mean, just my opinion of the matter. Hopefully something good comes from it.
I get how frustrating this is, but at the same time things are getting a little out of hand. As wrong as it is you are only going to hurt yourself by taking things to their level. If you genuinely feel this is hurting your business and have proof sue them for libel. In then end, buyers don't read listings and probably have no clue who either seller even is in this case. I don't know anything about jerseys, but it looks like you have a nice collection. It would be a shame if someone else's actions ruin a good thing. Libeling the other member and linking to their store probably isn't going to help you out any.

This seller who is slurring your name in hopes of interfering with your sales is breaking eBay policy. Contact eBay (again) and quote the exact policy they are breaking. Below is that policy. (I am certain there are others but I have searched without much luck.)
Offensive language policy

This policy comes very close but is not exactly your situation:

Members are not permitted to email buyers in an open or completed transaction to warn them away from a seller or item.
Some other members have mentioned that you have linked to the other guy's site and written some derogatory things about what this offensive seller is doing. This is against eBay policy and there will be little hope of getting eBay to take action if you are also violating policy. Whatever it is you are doing, delete it all now. Then contact eBay with your concern again. Otherwise you will draw unwanted attention from eBay and the wrong seller will get punished.

They may have already given out a warning and are giving him\her so many days to edit or remove the listings.

That is correct, not sure when it stopped but back when I was young companies used to do this ALL the time, literally on the radio and TV and everywhere they would SMEAR the other's name, here's the thing... It's actually a form of free advertising if you think about it, because it won't take people too long to figure out who the real deal is and I tell you another thing, if anyone's thinking of starting a smear campaign think of the types of customers that will attract.

True but you have to prove how much in sales you lost, also most attorneys back when I was young wouldn't take anything under $20,000 dollars because they get a percentage and likely this figure has gone up, so to get the straight story you'd probably want to call the lawyers and see what they tell you.

They may also not be aware that many buyers are avoid sellers who put down other sellers...it's unprofessional and not all that believable. It's possible that they are hurting their own business more than they are hurting the op's.

Some sellers have argued that they find selling on ebay not to be fun anymore.
EBay should address manny issues before more of the remaining fun goes away.

That's going around. I went into Chat to find out why my profile in my settings says USA and Canada only for shipping, but no matter how many times I click save and "apply to current listings" it wasn't being applied. Then I put up new listings, brand new, with the settings correct, and their system added worldwide shipping to it anyway even though it's a new listing and worldwide was never part of the original listing.
So my Antonio rep in chat said something really inane that made it clear he didn't understand my problem. I spent five minutes explaining why this was a problem and he just went silent and then left the chat. I was pretty angry, so I phoned, they said they'd escalate it to a ticket because it's a technical glitch, but my listings still show international shipping when I don't ship internationally.

And I'm back. Got suspended from the chat forum because how dare I show MOD replies. Ok for sellers to smear other sellers though.
So this the up date: I got hung up on the a ebay chat agent. I received the transcript of that conversation and I responded to that email. Not thinking that I would hear back from doing so, but behold I did.
This is what really what irks me. I have contacted Ebay so many times now and each time they promise they will act on this and still to this day the listing is still up . Below is one of many encouraging emails I receive where in the end nothing is done,. Absolutely frustrating

Glad your doing ok and a little calmer..listen I think we all feel the pain what your going thru, that is just horrible what that guy did to your livelihood, you have some beautiful jerseys listed and I see that they are the real deal as I have bought enough of them with 3 Hockey loving boys! I feel your frustration!
What jumps out at me are the multiple grammatical and spelling mistakes in the response. (Is it word for word?) To me, that is disheartening, and doesn't inspire confidence. Mistakes could suggest the person handling the matter is not thorough. Maybe they don’t grasp the seriousness of the matter. The offense is a clear breaking of eBay policy and the listing should be removed post haste, just as you have been saying.
Another troubling point is this: “I trust that this information is helpful.” Because it is patently not.
At this point, i would be tempted to have my attorney draft a cease and desist letter. And send it to the libeler, with a copy to eBay corporate. This is out-of-hand and ridiculous. Exactly what are you supposed to do?
A positive note—your competition’s reach is limited to only those buyers who find his listings. It is a niche category. Plus, any decent person reading his libel would likely view it as just that. Like another poster intimated, serious buyers would find such a statement both distasteful and suspect. Few people would pay heed to such a bald obvious tactic.

For now, look at it as free advertising. I mean, really, who would trust a seller who throws shade on another seller just to get people to look at their stuff? But they might check out YOUR items because he's got YOUR name slapped all over his listings - you need to have faith in yourself - a lot of people see through dirty tactics. But don't get down into the mud with that other guy, you know what they say - you'll only get dirty and the pig likes it.
