Basically I listed an Android Apple Watch for £400 (I emphasised it was an Android on the title and description a lot) and received an offer for £340. I accepted and the money went through. Shortly after I shipped the product they requested to cancel the order as “they thought it was something different” assuming they thought it was a real Apple Watch despite me adding it wasn’t. I then had to decline their cencel request as it had already been shipped. This buying now’s days he’s opened a file with eBay to get the money back and I told them that I can’t have it returned as I no longer have it and I don’t accept refunds. He took the risk when buying it and should’ve made sure what he was getting is what he wanted but got it anyway. I don’t know what happens now. Will the file damage me in anyway? Am I m the wrong for selling it and do I have to give him his money back. Keep in mind I have to pay £50 for this to happen because I promoted the listing. Can someone help, thanks.

There's no such thing as an "Android Apple Watch".  Apple doesn't make Android devices. You screwed up.  Refund them and accept the return.

 

Edit: You don't have a No Refund policy because no such thing exists on eBay.  You might have a No Returns policy (this must be a different account than where you sold the item or else it's hidden from me for some reason, as I can't see what you sold), but that only applies to reasons that don't fall under the eBay Money Back Guarantee.  I suggest you thoroughly read up on that policy.

Customer has a valid case of "not as described".    You cannot put word "Apple" on title line if you are not selling a genuine Apple products.

 

EBAY 30-Day Money Back Guarantee (supersedes "no returns" policy) and allows customers to claim "not as described, counterfeit, defective" you will be forced to give a full refund (purchase price + shipping BOTH ways).   EBAY does NOT require customer to prove their claim.   EBAY always rules in favor of the customer.

Ok I’ve got my package back. What’s the best way I can return the money to him? I don’t want to get into trouble as I meant the watch is Apple-styled which I should’ve put on the title. How can I get the held payment back to him?

Even " Apple Style" is a no no you can't use Apple in the title if it is not.

What can I do? Shall I send the item out to him and return his money when he gets the package? I don’t want to be in trouble with this and I do want to cooperate. I just need some help on sending his money back.

If they filed a claim there should be the option to respond with a refund.

 

Also to be clear, you can't use the word "Apple" anywhere in the listing if it's not Apple.

     I am assuming you responded to the return request with an offer of a full refund once you had the item back. If you have the item back and it is the same one you sent then you should be able to go into the return request and do the refund.

LOL....you do accept returns. All sellers on eBay do

      Actually, a seller CAN refuse to accept returns. However, that automatically translates into the buyer having the option of keeping the item and the seller still being forced by eBay to refund the buyer when an INAD is filed... Kind of a double loss for the seller - a refund on top of never getting the item back, unless the buyer has the moral character to send the item back after being refunded (yeah, right!).

Not necessarily.

I agree that we can have a No Returns policy but not a No Refunds policy.

But with some transactions, where the procurement price was very low, or the return shipping cost will be very high, it is cheaper for the seller to write off the return and take the loss as a business tax deduction than to pay for return shipping.

Or there can be an agreement that the shipment of fine crystal was smashed in transit, the fault is the seller's poor packaging , and there is no point in returning a box of shards.

Or there can be an agreement that the shipment of fine crystal was smashed in transit, the fault is with the shipper, who included a Damaged in Transit notice, and there is no point in returning a box of shards. The seller and buyer cooperate in the seller's insurance claim.

 

But generally, you are right.

The Money Back Guarantee overwhelms the buyer's preferences.
