Hello fellow Ebay Sellers. I sold an electric motor on Ebay to a buyer on June 30th and shipped it out. The buyer received the motor on July 3rd.. The same day the buyer received it, July 3rd, the buyer opens a return request of "Doesn't work or defective" and states: "the motor has an internal short.".. With the return request the buyer provides a photo of the item per Ebay requirements, and the buyers photo shows some obvious apparent alterations to one of the motor mounts on the outside. I first replied to the buyers return request with the following: "The photo of the motor appears to show some alterations to the motor mount and something peculiar sticking up on the back. What have you done to the motor and how did you wire it up?".. The buyer never responded to message... Several hours later that day same day July 3rd I accepted the buyers return request and provided the buyer a return label through Ebay return so the buyer could send the motor back. After three days on July 6th, that day I noticed the buyer had left me a lengthy negative feedback using my personal name and number along with various statements of saying I didn't allow a return, accused me of being a swindler, and ect... On July 10th my request for the removal of the LIBEL the buyer left in the feedback was approved, but the negative rating I was told will be left even though. On July 18th the buyer shipped the motor back in the mail. On July 21st I received the motor back in the mail. That day, July 21st, I checked the electric motor for a short and found that the motor did not have a short, and that the motor wired up functioned as it should. I made some short videos during the testing of the motor, of the motor being wired up and it functioning, and I also took some pictures of the area of the motor the buyer altered by permanently gluing some type of fiber material on the outside of the mounting area so it could no longer be mounted as it was designed. I messaged the buyer that same day July 21st of the return with attached photos of the area altered and the following message: "Upon receiving the motor back, I have noticed that you have altered the motor by permanently gluing something around the outside of the front motor mount. Also upon receiving the motor back, I checked the motor for function, I found that it is not defective, and that it runs on both the 1/4hp (high speed) and the 1/12hp (low speed). I have taken video recordings of the motor to prove it works. There was no reason for you to claim the motor is defective, and there was no reason for you to have opened a return request and shipped it back. I don't understand why you opened the return request? Please advise". The buyer has not responded to any of my messages... That same day July 21st I phone called Ebay help about the return of the motor and the damage, I asked about an appeal to the return, and the Ebay support on the call told me to not refund the buyer and wait till after Ebay refunds the buyer without seller resolution, then I could file an appeal, and provide the evidence to reverse the outcome of the appeal and get the negative rating removed and money back. End of that call.. The next day July 22nd, I called into Ebay help again, got with someone different to confirm what I was told, but this person told me I should not wait, to issue the refund now to avoid the points against me and losing Top Seller status, and then call in again to open an appeal. End of that call... Today, July23rd, I am confused and concerned for which to do? I read on Ebay "Help" that I can only appeal something that goes against me, such as, a return I did not perform. The knowledge of I cannot appeal something that I volunteer to do myself... What is the correct path here to a solid appeal in my favor?

Unfortunately, if you dont refund the buyer, Ebay wil do it for you, and you will get a defect. You have up to thirty days after the case is closed, to appeal, and provide 'new evidence'. Good luck.

Refund the buyer and do not wait for anything. I have to say all the photos and taping and emails are time consuming and usually don't help. You account is more important than this one bad buyer who only has "2 feedbacks"...not a good sign. We have all had a bad buyer. One of my buyer's returned a dark plastic bag with something gooey in it which I refused at the post office. I got charged another $20. trying the appeal thing. The mailman didn't even want to deliver it to me. So, we all had bad sales. I sell stamps which is also funny to the story. Another guy returned a girlie post card instead of my stamps. As long as sender returns with tracking you normally lose.
