Ebay seller do not send the items..

This ebay seller convert his entire business to a bullion business after he sold few gifts on ebay.. now he's selling bullion for much less than spot price.. his old feedbacks makes him appears genuine, he sold more than 130k from 1 item only in less than a week! Of course as he's selling less than melt value.. i hate having such people on ebay . Poor people are buying to protect their wealth and he is stealing it. I have waited few days as i was sure someone will come to write the negative feedback! He is not sending the products.. he is collecting money and mailing a fake items. What would ebay do in that case.. my friend told me he also bought from him 2 days ago he tried to cancel the order but the seller marked the order as shipped after contacted him to cancel the order.. what if he took all that money and never come back what would happen in that case!

Ebay seller do not send the items..

     You need to read through the Money Back Guarantee (MBG). The buyer  is pretty much covered for about any situation in which the seller attempts to rep somebody off. Buyers can also open chargebacks with their credit card company or other financial institution. 

     If they are selling at less than spot price that is their business and their pricing model.  As far as collecting money and not sending the items the buyer is protected and can file an Item Not Received case with eBay and if the seller cannot prove delivery the buyer will be fully refunded. 

     If the seller is sending counterfeit/fake items the buyer is also covered by the eBay MBG and their CC company. Upon receipt the buyer can open a Item Not As Described case with eBay or their CC company and will most likely be fully refunded and possibly not have to return the item. There are laws governing the mailing of counterfeit items. 

     If your friend tried to cancel an order and the seller shipped it anyway once you friend receives the item they can simply open a return request and return the item for a refund. There are caveats about who pays for the return shipping based on the reason selected for the return.  Read through the following.

What would ebay do in that case..

EBay  has a  HOLD on payments to new and occasional sellers.

Until they've been selling for 90 days and sold 25 items their payments will be held until tracking shows delivered, or in 21 days if there's no tracking. They can hold the payment for the full 21 days if you're selling in a high risk category.

Your friend has to wait until the last estimated date for arrival has passed then open a Claim through the original invoice.

If the seller cannot prove delivery (not shipping , delivery) your friend will be refunded.

The friend should not allow the seller to tell him that he should cancel the Claim. That is part of the scam.

The friend can come back to this thread to be walked through the steps to get his refund.

If your friend does not write English, they can write in their first language. Google Translate is helpful with that.

Friend should NOT refuse the shipment, if it arrives.

He must accept it and then make the Claim.

He is not sending the products.. he is collecting money and mailing a fake items. What would ebay do in that case

The buyer should simply file a "Not as described" dispute under the Money Back Guarantee and get his money back.

Have neither your nor your friend ever read eBay's Money Back Guarantee for buyers? It offers very good protection for buyers.  The catch is that the buyer has to read it and understand it, preferably before buying anything on eBay.

Here's a capsule version, but please read the entire thing for yourself:

Bought an item on eBay, but never received it and the last estimated delivery date has passed?

Open an item not received case within 30 days.

Bought an item on eBay, received it, but it's not as described? Open an item not as described case within 30 days.  The seller will be required to send you a prepaid return label and to refund in full when the item gets back to him.  

You and your friend need to read the MBG, and use it.  You are stating that eBay offers no protection.  You are so wrong.

Looks like the seller has closed shop and made their feedback private.

 

    I saw they had nothing currently listed but was not sure if they shutdown, took a break or if something else was going on. Regardless eBay will still cover the buyers refunds and go after the seller if they need to.  Based on some of the advertising in their sold listings it looks like they were a consignment shop and while they were shipping worldwide and utilizing the EIS program shipping precious metals internationally is difficult due to all the import restrictions and potential high VAT or import taxes.
