Ebay's Policy re Libel

Ebay's policy on feedback does not prevent a person from making libelous statements. It is time that Ebay took a more positive stance

That is what our civil courts and judicial system are for. eBay has no proof of libel and can not get involved with anything that does not violate their rules.

You are correct, a buyer can leave a scathing feedback that may not be removable. However, there are guidelines that must be followed. From the member to member contact policy:

”A member left feedback which I don't think is accurate or fair. Can I have it removed?

On request, we may remove some kinds of feedback – if it contains hate speech or profanities, for example. However, while we discourage rude and accusatory comments, we don't remove them if they're related to a specific transaction.

We would recommend getting in touch with the member and asking them to revise their feedback. Read our article on viewing, responding, and changing feedback.”

Ebay's Policy re Libel

"Feedback comments containing accusatory language such as "fraud," "liar," "cheater," "scam artist," or "con man." Although this type of comment is strongly discouraged, it isn't removed unless it also contains content that isn't allowed"

Ebay does give the green light for name-calling language by buyers, and only buyers, even if the feedback is not true.

As far as damage, anyone can say anything, and anyone can sue them for libel, or try. I would hope anyone suing for libel would only do so for egregious and malicious behavior, and actual proven damage to their business or person.

I don't know why ebay allows buyers to say these types of accusatory statements in feedback that allege seller wrongdoing, yet a scammer or vindictive buyer can freely call you names with impunity.

They did, sort of.  Your feedback doesn't count for anything anymore as far as your seller status is concerned be your donuts red or green.

So a good buyer who is intentionally defrauded by a bad seller,

can accurately warn others????

I shall explain lol. A buyer may leave a seller negative feedback because ebay thinks allowing them to vent and letting them see a sellers rep will keep them buying. Ebay does not allow sellers to leave negatives because it would possibly keep bad buyers and scammers from being able to make fee getting purchases.

Ebay's policy on feedback does not prevent a person from making libelous statements.

Correct, because it is not eBay's place to determine libel.

It is time that Ebay took a more positive stance

They have no incentive to.  Feedback has been lopsided for over a decade now, and sellers have proven over and over again that they are willing to put up with it in order to sell here.

For that same decade, we have read weekly predictions here about how sellers are "about to" leave, how the end is "about to" come, and how eBay is "about to" crater (or tank, or crash, or disappear, or sink, or fall apart,  or  be crushed).

But until those predictions are followed by a significant number of  ACTUAL sellers ACTUALLY leaving, eBay will continue to do what they do.

Feedback has no effect on eBay's assessment of a member's account.

FB has some effect on the few buyers that look beyond a 95% positive rating and actually read the FB.

If a FB is an outlier, those few buyers who read the FB may think less of the seller, but they may also think a LOT less of the drooling anger monkey that left it.  That kind of wild eyed crazy talk reflects more on the leaver than on the receiver.

If there is a solid pattern of negative FB left for the seller, that's one thing. A single nut? Pfft.  Sticks and stones....

The most effective FB, by buyers or sellers, is calm and factual.

And yeah. 95%.

Looking at the FB some really bad sellers get, and considering that they are still selling briskly, most buyers don't understand how feedback works.

@cashvaluerecovery2011

It may be your opinion, but that would be a completely false statement. Buyers do not even need feedback as they sold nothing. This is the only establishment out there that allows a business to rate a customer. Buyers feedback is for one reason only and that is to say thank you for your purchase.

To the OP: Ebay does remove any feedback that violates their policy. You may want to read up on that.

OP!  Judging by your feedback left for others you seem to be having more than your fair share of issues.  I would suggest that you might wish to be a bit more selective in picking your sellers.  The amount of negative feedback you have left might cause more than a few sellers to not want to do business with you.

WOW, took a peek. Interesting someone such as the OP could start a topic such as this.

I'm not sure what the laws governing LIBEL are in the OP's country, the Ukraine.

Ebay's Policy re Libel

A seller leaving a buyer feedback to say thanks is correct. The rest you said is not correct. What business is rating a customer? Buyers are the only one giving rating stars here and they arent a business. Not all sellers are businesses and as you said we dont rate them, only say thank you. Ebay rates no one so what are you talking about?

Buyers should be rated if sellers are. Both buyer and seller are customers of ebay as one makes a purchase that creates revenue and the seller provided a product that was wanted and pays the fees. If a buyer needs to know negatives and positves of a potential seller then why could the same not be true for sellers wanting only good buyers? Its because ebay wants the transactions to happen. That isnt opinion. Its fact. They said as much when they took sellers ability to give negatives years ago. Seriously take one half of a logical second to think. A seller with multiple negatives gets fewer buyers selling the same product with a better rep. A scam buyer who gets 2 or 3 negatives saying they returned a rock goes out of business quickly because sellers would cancel transactions expecting the worst. This helped keep this community a group of like minded people and it flourished. Bad apples were dealt with. Now scam buyers have nothing to peg them as bad. Invisible flags and ebays word is all we got.

So you tell me. Why do sellers deserve negatives but buyers do not? Since im factually wrong lol.
