Ebay removing my listings for being counterfeit but the items are Vintage & REAL !!!!!

Ebay has judged me guilty WITHOUT ANY PROOF .... " We removed this item to protect you and your buyers, because we believe it is LIKELY to be counterfeit. To make this decision we consider the details you provided about your item, reports that we receive from brands or members of the community, buyer feedback or the reasons buyers returned the item. "

"We believe it is LIKELY to be counterfeit " .... doesn't make in counterfeit ! It's NOT !

That would mean the 1000's of others like mine ON EBAY are all fake ... better remove those one's too !!!!!

NO buyer has returned one !

Not one bad feedback or comment !

On the contrary , I have 100% positive feedback , all 4478 of them !

What reports ? Let'e see them !

Ebay is a BULLY and i have no recourse !

Anyone else have this problem ?

Yep.  This has happened to me as well for an item I purchased direct from the company that makes it.  I was not sure if it was a competitor or a bot or VERO that initiated the take down so I asked.  eBay said the item had been reviewed by an actual person in trust and safety who believed it was "likely" counterfeit.

 

I had sold quite a few of them before the take down with no complaints or any issues.

 

So I just sold them on a different venue (fairly quickly) and tried to ignore the hurtful sting of basically being called a counterfeiter.  Every time I sold one, I felt better that eBay didn't get the fees for them.

As the email you received mentions, it could be one of your competitors that reported it - No doubt hat happens all the time -

Seems the site's high tech plan for that is to take it down without research and likely with a degree of surety it was a competitor.

Was it a VERO takedown?

If so, don't be mad at ebay. Ebay is just doing what they are told by the company representing the manufacturer.

If you can prove to that company that they are real, ebay will reinstate the listing.

This has happened to me before.

eBay can be pretty cavalier about this sort of thing because it's a huge site and investigating beyond what they do would likely take more manpower than they're willing to devote to it.

 

Even the vaunted Facebook reps actually took a YouTube video by some random guy having nothing to do with the manufacturer to justify that my tub of vitamin powder was fake, and then chided me for daring to list it. I had gotten the vitamins from the manufacturer, but that didn't matter to them.

 

The worst thing to do is take this personally - eBay is a corporation, they don't care so don't you, either. Try selling the items elsewhere.

This is eBay's site and it operates under eBay's rules and presumably in what eBay feels is eBay's best interests. 

 

And you are correct, you have no recourse  because you acknowledged eBay's user agreement which says you have no recourse: 

 

"we reserve the right to refuse, modify, or terminate all or part of our Services to anyone for any reason at our discretion"

I didn't mention the item because it could be anything ebay feels is " likely counterfiet "!

But to ansewer your question, it was a plastic car dealership emblem from the 1970-80s that they'd put on the rear of the car with their dealership's name on it .  IE - "Smith's Chevy , Las Vegas "

I bought a tote full of them from a Widow of a man that worked in the factory that made them in NJ.

So, i had a bunch of them, all REAL and mostly singles , a few doubles.

There are 1000's of them on ebay now , some plastic ,some metal.

Don't think it's a thing anyone would reproduce or ever has ?

How can you prove something you purchased at a flea market and that was made 50 years ago is Real ?

The photos and description in the auction were my "proof" and Ebay deemed them a lie !

I pride myself on being honest and fair and to my detriment , i believe the world is too.

So, when unfair and wrong things happen ( to me and others ) i feel it deeply.

I'm working on it ! lol

But am not ready to take on a hard and uncaring exterior .... yet !

Oh that's nuts, there are hundreds of these emblems on the bay, I've sold them myself.

    What category did you put them in? Ebay motors?

     That bit of information helps a bit. I suspect this may have been a bot takedown rather than somebody reporting it. I don't know what your post looked like but if you had it setup as having xxx of them from the tote then the bot may have keyed off the fact that you have xxx of a vintage item. Are most of the others you see on eBay single items or do they have multiples? 

    I purchase a LOT of Legos off a site called bricklink and they have issued a warning about sellers, ironically a lot out of China, that have hundreds or thousands of rare or difficult to find vintage pieces.

Not having this problem and sorry you are.  However as others have stated, if eBay removes an item for what ever reason, I suggest you don't relist it as you can jeopardize your account, especially one that was deemed selling counterfeits.  Most likely it's not the case, but again, it's eBay's playground and it's best just to get over your hurt feelings and move on.  Sell them elsewhere.  There are plenty of sites out there.
