EBay refunded payment to buyer without requiring return of item

EBay settled a disputed charge by a buyer's credit card company by refunding her payment, allowing the buyer to retain a $1,400 chandelier and getting a refund. I advised EBay that I had a statement from my electrician confirming that my description of the item was accurate, but it apparently didn't get into the review. What recourse do I have to compel the buyer to return this item?

EBay's policy states: "If the buyer is sending an item back because it doesn’t match the listing description or it arrived damaged or faulty, you’re responsible for the cost of return shipping, even if you don’t offer returns. "  There is no exception for CC disputes stated here.  

 

Regardless of the merits of this specific case, it appears to me that EBay's CC Dispute procedure is deficient, arbitrary, capricious, and self-serving in the following respects:

 

1.  When notified of the dispute, EBay provides lists the category for the buyer's complaint:  ITEM DOES NOT MATCH LISTING DESCRIPTION.  The lack of information about the seller's allegations makes it difficult to dispute the allegation.  

2.  EBay limits your response to a handful of photos, and does provide a field to include a summary of prior communication with the buyer, or supporting documentation that confirm the item status.

3.  EBay sets a short deadline to respond to the buyer's allegations, and counts weekend days as well as business days.  In my case, I had two calendar days to respond.

4. EBay does not allow subsequent sellers to submit supplemental evidence about the dispute after the initial submission, and does not provide a way to communicate with them about the dispute to identify what additional information they need to make an informed decision.

5.  EBay does not state its reasons for making its dispute resolution decisions, making it difficult to challenge the dispute successfully.

6.  EBay does not address the issue of buyer returns in its communication, leaving sellers wondering why the item was returned and how to retrieve their item from the happy buyer.  EBay's published return policy implies that sellers will receive a return in the event of a refund, provided they pay for shipping.

7.  By refunding the entire purchase price plus shipping to the buyer, EBay voids the original transaction and retrieves all proceeds from sellers' accounts.  However, they retain the state sales tax they collected for the now-voided transaction, as well as their own hefty transaction fees.  This policy is inconsistent with every other on-line retailer, including Amazon.  By retaining its share and the state tax share of the transaction proceeds, EBay appears to be violating its contractual responsibilities for backend transaction settlement.  

8.  EBay's CC refund/return practices do not seem calibrated to achieve a reasonable adjustment of interests between buyer and seller, probably because EBay sellers are a "captive class" with little to no power in this relationship.  If a buyer identifies a $10 issue with a $1,500 item that does not affect function or appearance, is it reasonable (or legal) for EBay to force the seller to forfeit the purchase price, the item, and incur double sales tax and Ebay fees?

 

I'm sure many of you feel that since you haven't been harmed by this practice in the past, and feel that it's "just the way things are done", or "Seller Beware", or "you should have known better".  While EBay's written policies and unwritten procedures regarding CC disputes may impact only a small percentage of transactions, this behavior can only encourage buyers to circumvent the standard EBay return policy to obtain our merchandise at no cost.

Unfortunately none.  What type of claim was this?  Did you accept the return or was it a CC chargeback claim?

Your listing shows that you do not accept returns.  That tells eBay and everyone else that you don't want the item back.

That is the reason that your buyer was able to keep the item and get a refund.

REMEMBER: NO RETURNS DOESN'T MEAN NO REFUND. 

eBay has a MBG.

If it's a dispute filed by the buyer with their credit card, then ebay has no choice and cannot override the banks decision.

 

It would be unlikely that you could compel the buyer to return something that they got for free unless they are honest so you can ask them but it doesn't look good.

If customer files "credit card chargeback" (keep item and your money).    If you dispute claim (you will never win) and get charged $20 fee and get defect on your account.   EBAY cannot help you (they have no control over credit card company). 

 

This is why most sellers "allow returns" (at least you get your item back).    Also you should understand that your "no returns policy" can be overturned  by EBAY Money Back Guarantee if customer claims "not as described, defective, counterfeit" (forced to refund purchase price) plus shipping BOTH ways).  EBAY does NOT require proof of claims.   EBAY only looks at return tracking# (not what is inside the package).

 

Unfortunately, you are out of luck...no way to force customer to return item.

”No returns” means no returns for buyer remorse.

A statement from your electrician is worthless. They could lie or the statement could be faked.

Sad to say but the buyer does not have to return the item. I went thru this and all ebay says is to ask the buyer to return it but even if they did return you will have to pay the shipping as well as lost money for the item. ebay is only concerned about keeping buyers even dishonest buyers happy they let this go on everyday. I removed all high price items from my listings and will no longer sell them here. it is horrible what ebay allows these dishonest buyers to get away with.

Yep fighting a similar right now. Awarded buyer with signature delivery and messages from buyer acknowledging delivery. eBay doesn’t care. Seller loses a lot on here.

That is why I don't sell expensive items here.  eBay is now notorious for letting buyers run amok filing false claims and leaving the seller to twist in the wind out the money and their items.   eBay will not force the buyer to do anything now that the refund has been issued.  They go along with anything the buyer says and basically the seller is SOL and eBay washes their hands of the issue.  Great company they're running here, huh? *eyeroll*

This is why most sellers "allow returns" (at least you get your item back).

Accepting returns does not mean you get YOUR item back.  In this case the buyer bypassed the ebay claim process and went directly to their payment provider. They never asked the seller to return the item for a refund.   There is no option for a seller on the resulting PAYMENT DISPUTE form to offer a refund upon return or to provide a return shipping label.  

Instead, this is one of those 'claim forms' for a not as described chargeback that allows ONE photo to be submitted as the sellers's evidence.  They lose and pay the $20 extra.  A buyer in this instance is not required to return anything in order to get the refund from the seller's proceeds when they do a chargeback.

You can buy those statements on eBay, similar to certificate of authenticity. It holds no value.
