I have a store. Every month I modify my listings (including lowering the price) I DO NOT WANT ALL MY LISTINGS "WHICH I AM PAYING FOR !!!@" to automatically relist.
EBAY IS HORRIBLE !

Do you have a legal basis for this proposed lawsuit?
I'm not sure the courts will not look favorably if your only argument is "I don't like it".

Did you accept their Terms of Service? If so, you agreed to changes. You have no grounds to sue.

FYI. As for suing, in the eBay User Agreement, every person who uses the platform has agreed to final and binding arbitration in place of court, except in cases brought to Small Claims court. (Or for those who opted out.)

Here's a few legal basis arguments, off the top of my head.
I'm not a lawyer, but I've seen similar cases previously.
1) Ebay sellers get X free listings per month, but some months have more than 30 days. GTC does not respect this fact and renews every 30 days only.
2) If an Ebay seller does NOT want their listing to renew, they must end the listing early - thus they are not getting the full 30 day duration that they paid for.
3) Various automatically renewing items have been ruled (at least in US courts) to be null and void, depending on how they were implemented. Even many of the "as seen on TV" type scams that enroll you into a club (like pie of the month or something) have active consent for renewal when you accept the package as you can actually deny the delivery. Ebay GTC listings have no such mechanism.
4) GTC listings with 0 items AND the Out of Stock feature enabled will relist indefinitely (or 3 months - so Ebay claims). That means you are paying for a listing with nothing to actually sell.

Other than the base 50 listings that all members get, it's not free. Stores have to pay a store subscription fee, and that fee is paid by 99.99% of stores because of the extra listings they receive. I can't think of any other store features that are worth $20+/month.

1) Don't start listing of the first of the month......problem solved
2) if you list an item and it sells on day 14 the listing ends, you don't get the full 30 days do you think eBay should refund a pro-rated amount of your original listing fee?
3) eBay offers an anytime cancellation without penalty and without requiring any advance notice.
4) you don't understand how the OOS option works, if you have zero stock for a full cycle then fees are NOT charged. Even if they were see #3 and of course the OOS option is just that... an OPTION.

Are you DENSE? I mean... really... are you? You can still get hit with fees due to your listings from the PREVIOUS month auto-renewing. It doesn't matter when you list, it matters what you have listed that's getting auto-renewed.
The OOS option does indeed charge you. However, Ebay (at it's discretion) will rebate the fees as a credit. If I get charged $1,000 in fees, I must pay Ebay that $1,000. They may then CREDIT me, but I won't be getting $1,000 back from Ebay in a check. I'll have a $1,000 credit on Ebay, which can be revoked at any time.
As for selling - are you even a seller? Because I don't see any listings for you. You have zero idea what you are talking about. I've seen you blatantly and blindly defend Ebay for a policy that IS NOT WANTED.

Totally Agree.....GTC must mean and "Grab Thy Calfs"...The Further/More I Sell after 15 years...They had me to my Knees and Now want me to Grab Thy Calfs....The deeper they stick it in...The More I want to Run....Not Fun at all on Here Anymore!!

They have been sued at least once over GTC
In 2013, eBay set up a $6.4 million settlement fund in response to a judgment against them, and paid that out to qualifying members of the class action lawsuit.
Sounds strangely familiar to what these boards are talking about lately.
"The suit is entitled Richard Noll and Rhythm Motor Sports, LLC v. eBay Inc., Case No. 5:11-CV-04585 (EJD), and alleges that eBay did not adequately explain that fees for the Good ‘Til Cancelled listing duration (“GTC Listings”) would be charged every 30 days."

I agree that the new GTC only policy makes things difficult for some sellers who rotate stock in and out, but it's eBay's sandbox so they make the rules. One change I think they should make is to have GTC listings renew every 31 days, so no listing would ever renew more than once a month. For many of us the new policy has absolutely no effect.
Note that many posters here use a posting ID, not their selling ID, so one's criticism of their comments should be based on that only, not how many listings one imagines they do not have. I have a few listings so I am somewhat acquainted with how eBay works.

Correct me if I'm wrong, but isn't the big argument about GTC that you will be charged when the relist happens before the end of the month? I keep hearing it framed as a cash grab and how it will put people out of business......

Close your store and get out of their sandbox. I am out on March 31. Letting all my listing run out. Been a fun ride for 21 years. Made lots of money. Paid off my home etc. Newly retired and doing as little as I can get away with!!! I wish all the newbies the best but this is not a good time to be an online seller.
