Dear eBayers, Please help me!

I have been in eBay for over 9 years, and I am a buyer and also a seller.  I have purchased hundred items without filing a return until this time.

I purchased a skin care product and the discription stated: Sealed.

When I received the item that is not in the cellophane wrapping, I put it back to the shipping box.  I didn't open the item box that was sticked by a tape.

I contacted the seller for returning.

The seller said she removed the cellophane, but it was sealed.  It wasn't because the seller used a tape to stick the box.

Therefore, I requested a return through ebay.

The seller received the item back on Sept. 30th

Today she told me that I already used the item, and she will file a fraud to ebay.

Please tell me what I have to do to show my honest.

I greatly appreciate your time and help.

Go back into the case and escalate it thereby asking eBay to take over.

They will see by the tracking that the seller got the item back, and force seller to refund you your full purchase price.

Seller is bluffing you about the 'fraud' report.

Can The buyer escalate anything yet as eBay does give the seller 6 business days after return to refund

or  how does a buyer escalate if a seller decides to fight the return as false SNAD ?

Ebay gives the seller three business days to refund; buyer would win.

No they give the seller 6 business days to refund. The exception being, the seller didn't accept the return and the buyer asked eBay to step in and ebay told the buyer to return--in that case the seller gets no business days to refund, eBay does it as soon as the item is delivered 🙂

@labs118

When I checked this out, not that I was questioning you, but since there was question regarding this, and I got into it by believing another's posts, I can see why the confusion was there.  They mention three days response on the seller's part, and later on say refund 6 days, so I think the two were confused and the 3 days for response was taken as the time to refund as well.

Hope that makes sense!  But I do appreciate knowing the correct time frame.

Re: Dear eBayers, Please help me!

Ignore and purchase from someone else. BTW, 75% of items on eBay are "recovered" (store returns, salvage, open box, damaged, old stock, etc.). If you want new and sealed you may want look at other options. This is especially true in HABA.

Thank you very much for your  help.

Right after I requested a return, the seller accept it, so I didn't need to escalate.

Also, the seller refunded my payment on the day she received the item back (on Sept. 30th)

Today she told me she will file a fraud.

I didn't open the box, but she said that I used it.

At least on the surface, it appears that the seller maybe sold you a previously used item.. and not necessarily by the seller, but perhaps a department store 'return' that she got in a lot for resale.  (...although it wouldn't be the first time a seller has 'tested' a product, and then claimed it was new and never used...)

Her error was in listing the product as *sealed* when it did NOT still have the original cello wrap around the box.  Many buyers would consider that suspicious, and certainly not exactly as described.

Don't worry about her at all, and don't worry about your standing on eBay.  You're fine.  Hopefully this seller learned her lesson too.

The seller is just childish and angry that you didn't accept the item in a condition that was most definitely not as described. This is obviously not your fault.

I hope you'll accept the advice to leave a negative feedback for this seller which states only the facts about the item (not mentioning the return or refund).

When I contacted the seller regarding the item isn't sealed as described, she told me that she herself removed the cellophane.  If the cellophane removed, it can't be sealed.  To my knowlege, the Shiseido furture solution products have cellophane wrapped the box.  When the cellophane removed, the product boxes do not have a packing tape to stick it.

I took picture of the item box that has the packing tape to stick the box and request return it. The seller accepted a return right after receiving a message from ebay.   She refunded my payment on the same day she received the item  back.  That meant she already inspected the product before refunding my payment.

3 days later, she threaded me that she will file a fraud because I used the item.

It is obvious that she isn't honest, and she scares buyer to avoid a negative feedback.

Thanks so much for your advise about a negative feedback.  I have never left a negative feedback to any sellers.  I think you have a good idea for me because she deserves it.

And that is all the more reason why she deserves a neg.  And it should read something like "Item described as new/unused but received opened product."  Once that cellophane is removed, it cannot be described as new/unused because nobody knows for sure if it is or isn't.  Certainly not this seller.  If she wants to report a fraud, she should be reporting herself.

Sellers like this make the rest of us have to work that much harder.

Don't mind the nice photecade: Your seller is bluffing --

there is no way at eBay to report a problem with the buyer.http://pics.ebaystatic.com/aw/pics/sc/sr152/Report-a-problem-with-the-buyer-2.jpg
