eBay claims that the otterbox in box that I sold was a counterfeit...but does not refund my buyer. ??? A week later I receive an email from a NY law firm saying that eBay gave them my info and that they’re representing the buyer. I bought this phone on eBay 2 years ago and it didn’t fit my phone. It took me 3 weeks to sell it for a measly $11.99. I shipped it and a week after that was told it was a counterfeit...
The email from the law firm offers a link to pay $1000 to cover this suit against me.
I smell a fish.
What would you do? I’ve started by asking my buyer if he’d consulted a lawyer. eBay has given them my name address and email. Is there a real contact phone number for eBay any more? I need to talk to them. Any one else experience this?

I would do nothing. I would not click any links and I would pay nothing.
I would NOT contact the buyer.
This smells to high heaven to me too.
Maybe try a private message to eBayforBusiness on FB.

These are credible US cs Agents that work for ebay and can more readily help you with your issue more than the cs that ebay offers overseas.

I believe Otterbox can claim it's counterfeit and sic a lawyer on you.
I believe if a buyer suspects it's counterfeit he is entitled to a refund but not $1000. You're not entitled to a windfall because you receive an item you believe is not as described.
Has the buyer asked for a refund?

An email from a law firm? Legit law firms don't send demand letters via email. Is there a name on the email. Do a google search and see if the firm even exists. If there is a name of a person in the email, search your state's bar ("State Bar of X") to see if whoever it is is a licensed attorney.

Buyer isn't suing you.
No law firm is going to take a case over a $12 item.
Second, if you were being sued you would be served papers in person by a process server, not sent an email.
This is just a scam, stop responding to it and they will stop too, people who run scams run hundreds at once and will just switch their focus over to whoever is responding.
It also might not even be the original customer, their account might be compromised and they could be doing this to the person's entire purchase history.

I would ignore it for the moment. If the alleged law firm represents the buyer and not Otterbox then it should be a matter for small claims court. At the same time I would hedge my bets and also refund the buyer.
