Counterfeit Policy Item(s) Removal Appeal?

I’m a long time 15+ year, top rated, 100% feedback eBay seller. I sell Polo Ralph Lauren products new with tags all sourced directly from Polo Ralph Lauren stores.

 

ebay has removed my listings due to their “counterfeit policy”. How do get in touch with someone to appeal this?

 

my items all show actual pictures of the product, the authenticity QR codes, tags, etc.

Do not relist until the matter is resolved.


If a VeRO take down you can fight it, as you have a legal right to resell an authentic legally obtained item as long as you don't otherwise infringe on the owner's rights, or have a contract with the company agreeing not to. Companies can not legally have ebay remove an item just because the don't want you selling it on ebay. Unfortunately some abuse VeRO and do it anyway.


However, if this wasn't a VeRO complaint, but an ebay take down, you have a problem. Ebay appears to be doing more and more of this sort of thing against sellers of various products without giving them any recourse whatsoever to appeal it. The best you could do is have your attorney send a letter to ebay's legal department, but hardly worth it for a single item.


Obviously ebay is trying to protect against counterfeits, but at times seems to not be applying the take downs fairly to all sellers. I suspect if this practice continues to escalate, some public advocate or news group is going to call them out on it.

Sometimes the stock photos will set off the bots.  Might be why they were removed.  It's always a better idea to take your own photos.  Although you state they are authentic and I believe you that they probably  are, I wouldn't re list them as it could jeopardize your account.  There are other platforms you could probably sell them on.  Probably the best idea in my opinion.

Large corporations now use the term "counterfeit" to include unauthorized sales and sellers such as yourself who is unlikely to be an authorized dealer.  This is especially true with very high margin items such as beauty care products and "designer" items like Polo Ralph Lauren products.  Your situation also begs the question as how are you able to purchase the items from Polo Ralph Lauren stores and resell them for a profit on Ebay.

It's real easy to walk in to any Marshalls or T.J Maxx and go directly to the clearance rack and find Ralph Lauren and other big designers with prices cut to a fraction of the original price. Don't tell anyone let's keep this our secret?

I do have to wonder how many of our esteemed seller friends from offshore are getting these notices. I'd bet not many.

Not a secret and not exactly purchasing "directly from Polo Ralph Lauren stores".  Again, taking the lead from Chanel, companies have argued successfully in court that non-authorized sellers create a counterfeit experience. It is nonsense but Ebay will remove listings upon request from these corporations.

I had a similar problem without vero indication. the main problem here is how a seller would know if the product going to be listed will be found unauthorized/counterfeit by ebay or not before listing? there is no way to predict/know this?

I am trying to figure out how to avoid this, asked ebay CS and they couldn't even respond what I'm trying to understand. because of this I don't know how to build up a safe account here with their non helping approaches.

You often can't know.  What type of item are you trying to list.  Some items are very problematic to sell on ebay.

it was a vintage adidas tshirt, the weird part is i have other 10-11 listing of these group without problem too. I'm sure that whoever defined my product as counterfeit have no idea about vintage products. most of my inventory have even the cardboard tags on, deadstock, purchased by my family members at their eras from official adidas stores. my concern is what I am going to face when i list a different item. it feels like a booby trap. i'm stuck for my next actions.

It's not a VeRO removal so there's little chance that ebay will let you relist.

 

(If VeRO and you were to appeal and prove authenticity, the VeRO rep could notify ebay to allow the item to be relisted.)

Hi Pete Smith, @onlineelectrics 

 

 in the message sent to you from the group responsible for your takedown, there will be listed contact information. You contact this Vero member directly to appeal. Once your message is sent, the Vero member has 5 days in which to respond, i believe.
